An Act To Require That Comprehensive Substance Use Disorder Treatment Be Made Available to Maine's Incarcerated Population

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 34-A MRSA §1402, sub-§10-A  is enacted to read:

10-A Substance use disorder treatment program.   The commissioner shall establish and maintain a substance use disorder treatment program in the correctional facilities, which must, at a minimum:
A Provide for a substance use disorder assessment on intake for all clients to assess the risk of overdose or withdrawal and to determine treatment options;
B Include comprehensive behavioral treatment options for clients that involve recovery groups, individual counseling and identification and treatment of associated mental health disorders;
C Provide a variety of medication-assisted treatment options and other substance use disorder treatment options for clients with substance use disorder for treatment of withdrawal and maintenance therapy; and
D Coordinate with representatives of local recovery communities and providers of local case management services to offer peer support and comprehensive treatment options to clients after release.

Sec. 2. Appropriations and allocations. The following appropriations and allocations are made.

Initiative: Provides ongoing funding to establish and maintain a substance use disorder treatment program in correctional facilities, including an assessment on intake for all clients, behavioral treatment, medication-assisted treatment and peer support and comprehensive treatment options after release.

This bill requires the Commissioner of Corrections to establish and maintain a substance use disorder treatment program in the correctional facilities, which must provide for an assessment on intake, provide a variety of behavioral and medication-assisted treatment options and offer peer support and comprehensive treatment options after release. The bill also provides funding for the establishment of the substance use disorder treatment program.
