An Act To Provide Consistency in the Laws Governing Culvert Replacement
Sec. 1. 23 MRSA §705, last ¶, as amended by PL 1999, c. 473, Pt. C, §2, is further amended to read:
For locations on town ways and on state and state aid highways within the compact area of an urban compact municipality pursuant to section 754, the municipality must be petitioned by the abutter pursuant to section 704. Should a permit be issued, the abutter shall provide, at the abutter's expense, a culvert satisfactory to the municipality, which must be installed at the abutter's expense by, or under the direction of, the municipality shall install and maintain. The culvert must be maintained by the municipality, except that when the municipality determines a culvert replacement is required, the abutter is responsible for the cost of a replacement culvert.
