An Act To Require the Public Utilities Commission To Open an Investigation Whenever It Initiates a Management Audit
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 35-A MRSA §113, sub-§5 is enacted to read:
5. Investigation; participation of parties. Upon the initiation of a management audit under this section, the commission shall open an investigation into the matters that are the subject of the audit. The investigation is an adjudicatory proceeding pursuant to the commission's procedural rules. Parties to the adjudicatory process must have full access to the information supplied to the auditor.
SUMMARY
This bill requires the Public Utilities Commission, whenever it initiates a management audit of a public utility, to also open an investigation into the same issues that are the subject of the audit. This investigation is an adjudicatory proceeding with full rights of intervention and participation as allowed under the commission's procedural rules.
