Amend the resolve by inserting before section 1 the following:
‘Emergency preamble. Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and
Whereas, the spaceport complex project is time sensitive; and
Whereas, this resolve establishes the Maine Spaceport Complex Leadership Council, which needs to begin work immediately; and
Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore, be it’
Amend the resolve in section 2 by striking out all of subsection 1 (page 1, lines 21 to 39 and page 2, lines 1 to 5 in L.D.) and inserting the following:
‘1. The following voting members:
A. Two members of the Senate, including a member from each of the 2 parties holding the largest number of seats in the Legislature, appointed by the President of the Senate;
B. Two members of the House of Representatives, including a member from each of the 2 parties holding the largest number of seats in the Legislature, appointed by the Speaker of the House;
C. Two members of the public appointed by the President of the Senate as follows:
(1) A representative of an in-state manufacturing business with 25 or more employees that is involved in the aerospace industry; and
(2) A representative of an in-state private foundation;
D. Two members of the public appointed by the Speaker of the House as follows:
(1) A representative of an in-state manufacturing business with fewer than 25 employees that is involved in the aerospace industry; and
(2) A representative of a college or university in the State with expertise in aerospace; and
E. Two members of the public appointed by the Governor as follows:
(1) A representative of an entity directly funded by the National Space Grant College and Fellowship Program; and
(2) A representative of an in-state nonprofit research organization that uses satellite-based data.
In making appointments of members of the public, the appointing authorities shall make every effort to appoint persons from generally recognized organizations representing the entities mentioned in paragraphs C, D and E.
If a member appointed under paragraph A or B ceases to be a member of the Legislature as a result of an election during the course of the council's work, the appointing authority shall make a new appointment in accordance with the applicable paragraph to replace that member and that member ceases to be a member of the council; and’
Amend the resolve by striking out all of section 3 and inserting the following:
‘Sec.
3. Appointments; convening of council. Resolved: That the appointing authorities shall make appointments to the council within 30 days of the effective date of this resolve. The appointing authorities shall notify the Executive Director of the Legislative Council once all appointments have been completed. After appointments of all members, the cochairs shall call and convene the first meeting of the council. If 30 days or more after the effective date of this resolve a majority of but not all appointments have been made, the cochairs may request authority and the Legislative Council may grant authority for the council to meet and conduct its business.’
Amend the resolve in section 4 in the first line (page 2, line 27 in L.D.) by inserting after the following: "shall" the following: ', to the extent resources are obtained in accordance with section 7,'
Amend the resolve by striking out all of sections 7 and 8 and inserting the following:
‘Sec.
7. Staff; funding. Resolved: That the council shall, if possible, enter into an agreement with a Maine-based entity directly funded by the National Space Grant College and Fellowship Program to provide necessary staff and other support for the study at no cost to the council, including but not limited to any resources necessary to develop and produce the strategic plan under section 4. The agreement may not provide that the entity compensate council members pursuant to section 6.
Sec.
8. Submission of strategic plan. Resolved: That, no later than November 1, 2021, the council shall submit any strategic plan developed pursuant to section 4 to the Governor and the joint standing committee of the Legislature having jurisdiction over economic development matters. The council shall include with the strategic plan information regarding any financial commitments from potential users and tenants of the spaceport complex. The council shall make any strategic plan submitted under this section accessible to the public on a publicly accessible website maintained by the Department of Economic and Community Development.
Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.’
Amend the resolve by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.
SUMMARY
This amendment does the following:
1. It adds an emergency preamble and emergency clause;
2. It adds language clarifying that a Legislator initially appointed to the Maine Spaceport Complex Leadership Council who subsequently ceases to be a member of the Legislature following an election will be replaced on the council by the appointing authority;
3. It removes the language conditioning the meeting of the council on the availability of funding;
4. It adds language clarifying that the development of the strategic plan by the council is subject to the availability of funding;
5. It restructures the language describing the funding arrangements to make clear that the council is responsible for all costs other than reimbursement of Legislators and of council members who are not able to secure reimbursement through their employers; and
6. It changes the plan report date to November 1, 2021.
