An Act Regarding Reimbursements to Municipalities for General Assistance
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 22 MRSA §4311, sub-§1-D is enacted to read:
1-D. Reimbursement in excess of maximum assistance. When a municipality provides general assistance to an applicant as a result of an emergency as described in section 4308, subsection 2 and the emergency payment is in excess of the maximum level of assistance established by the municipality according to section 4305, the department shall reimburse the municipality as follows:
A. Seventy percent of the amount of the emergency payment up to the maximum level of assistance; and
B. One hundred percent of the amount of the emergency payment in excess of the maximum level of assistance.

This bill enacts a recommendation of the stakeholder group established pursuant to Public Law 2019, chapter 515, section 4. The bill requires the Department of Health and Human Services to reimburse a municipality for the amount of general assistance provided to an individual in an emergency situation that is in excess of the maximum level of assistance established by that municipality.
