LD 29 proposed to implement the recommendations of the Task Force to Reduce the Burden of Home Heating Costs on Low-income Households established in the Second Regular Session of the 119th Legislature by Resolve 1999, chapter 132. The bill proposed to:

1. Establish a summer "fill" program to provide low-income households that are eligible for fuel assistance through the Low-income Home Energy Assistance Program (LIHEAP) with an initial supply of fuel;

2. Require the Maine State Housing Authority to identify the most effective way to provide adequate funding of the anticipated 25% nonfederal share of the weatherization program;

3. Establish a program funded by a bond issue to allow low-income and middle-income citizens to obtain low-interest loans or grants for energy conservation improvements;

4. Require the Maine State Housing Authority and the State Planning Office to investigate the possibility of establishing a separate Office of Energy Conservation within the Maine State Housing Authority;

5. Require the Maine State Housing Authority to annually for 3 years investigate the possibility of increasing the percentage of LIHEAP funds for weatherization services;

6. Require the Public Utilities Commission to monitor the effects of interruptible gas services on the supply and price of home heating oil; and

7. Require the State Planning Office to conduct a study to determine whether the State of Maine can reduce its per capita residential energy consumption by 25% by 2011.

Committee Amendment "A" (H-48) proposed to authorize the Maine Rainy Day Fund to be used to provide a working capital advance to the Fuel Assistance Reserve Fund in the event a General Fund unappropriated surplus is not available for that purpose. It also proposed to require the Maine State Housing Authority to study fixed-price fuel oil contracts for fuel assistance recipients and to require the Maine State Housing Authority and Finance Authority of Maine to fund a program that provides low-interest loans or grants to moderate-income Maine citizens through the issuance of private activity bonds. The amendment also proposed to reduce the amount of general obligation bonds proposed to be issued to fund low-interest loans or grants for energy conservation for low-income citizens from $8,000,000 to $5,000,000. It proposed to amend the wording of a proposed referendum question to be submitted to the voters of Maine to reflect the lowered bond issue amount. It also proposed to eliminate from the original bill a proposal to establish an Office of Energy Conservation within the Maine State Housing Authority. Finally, the amendment proposed to delete a requirement that the Public Utilities Commission monitor the effects of interruptible gas services on the supply and price of home heating oil in Maine and to change various reporting deadlines for reports to the 120th Legislature.

Although many of the provisions of LD 29, as amended, were incorporated into the Part 2 budget (LD 855, Public Law 2001, chapter 439, Part GG), the bill was nevertheless carried over to the Second Regular Session for additional consideration by the Joint Standing Committee on Appropriations and Financial Affairs.

LD 39

An Act to Authorize a General Fund Bond Issue in the Amount of $9,000,000 to Purchase School Buses for Public Schools

LD 39 proposed that bonds be issued in the amount of $9,000,000 to be used to purchase school buses for Maine's public schools. Proceeds of the bond issue would be disbursed over a 3-year period. The bill also proposed to require the Department of Education to adopt rules to determine the criteria for bus replacement that require, at a minimum, that buses that are to be replaced must be at least 10 years old and have mileage in excess of 150,000 miles.

An Act to Fund the Endowment Incentive Fund

LD 42 proposed an appropriation of $14,000,000 in fiscal year 2001-02 to the Endowment Incentive Fund to match qualified private donations for academic purposes at the University of Maine System, the Maine Technical College System and the Maine Maritime Academy.

An Act to Require Full Funding of the State's Share of General Purpose Aid

LD 60 proposed to require that the state share of actual local program costs of school administrative units be fully funded by specifying that the subsidy percentage reduction percentages for all program costs are 0% beginning in fiscal year 2001-02 rather than in fiscal year 2002-03 as provided under current law. This bill also proposed an additional amount of General Fund appropriations for the General Purpose Aid for Local Schools program to fully fund the state share of actual local program costs.

An Act to Reinstate Tax Deductibility of Qualified Long-term Care Insurance

LD 79 proposed to repeal, retroactive to January 1, 2000, changes that were made to the income tax deduction and credit for long-term care insurance premiums by restoring a requirement repealed in 1999 that eligible policies be certified by the Superintendent of Insurance.

Committee Amendment "A" (H-432) proposed to extend the income tax deduction and credit for federally qualified long-term care insurance to include policies certified by the Superintendent of Insurance.

LD 79 was originally referred to the Joint Standing Committee on Taxation. When removed from the Appropriations Table, this bill was committed to the Joint Standing Committee on Appropriations and carried over to the Second Regular Session.

8. Identify the fiscal year 2001-02 and 2002-03 funding levels for the foundation, debt service and adjustments components of General Purpose Aid for Local Schools.

PART D proposed to authorize the Department of Administrative and Financial Services, Bureau of Revenue Services to implement tax revenue compliance initiatives under current tax law.

PART E proposed to eliminate the contingent effective date for the Quality Child Care Tax Credit and eliminated the transfer from the Fund for a Healthy Maine that offsets the General Fund revenue loss.

PART F proposed to eliminate the transfer of funds from the Capital Construction/Repairs/Improvements - Administration program to the Reserve Fund for State House Preservation and Maintenance.

PART G proposed to establish voluntary employee incentive programs.

PART H proposed to authorize transfers from the Maine Rainy Day Fund to the General Fund in fiscal year 2001-02 and fiscal year 2002-03 and allowed the General Fund to retain the interest earnings on the balances in the Maine Rainy Day Fund. It also proposed to increase the amount of the transfers to the Maine Rainy Day Fund at the end of fiscal year 2001-02 and fiscal year 2002-03 from 1/2 of excess General Fund revenue to 3/4 of excess General Fund revenue and prohibited transfers of excess revenue to the Retirement Allowance Fund pursuant to the Maine Revised Statutes, Title 5, section 1517.

PART I proposed to change the Business Equipment Tax Reimbursement (BETR) to one payment per year.

PART J proposed to permit changes to several dedicated funds and to federal block grant allocations to cover any approved salary plan adjustments and approved reclassifications and range changes. It proposed to restrict use of allocations from the State Alcoholic Beverage Fund and the State Lottery Fund. It proposed to establish guidelines for carrying forward federal block grant funds and to establish guidelines for carrying forward several dedicated environmental funds.

PART K proposed to authorize the transfer of $1,000,000 in fiscal year 2001-02 and $400,000 in fiscal year 2002-03 from one-time enhanced federal matching funds in the Department of Human Services to General Fund unappropriated surplus.

PART L proposed to lapse $1,027,712 in fiscal year 2001-02 and $2,444,416 in fiscal year 2002-03 from the Carrying Balances - Inland Fisheries and Wildlife program to the General Fund. It proposed to provide that appropriations to the Department of Inland Fisheries and Wildlife associated with search and rescue are not considered amounts appropriated to the department for purposes of the Constitutional requirement that appropriations to the department may not be less than revenues.

PART M proposed to provide for the closing of state liquor stores.

PART N proposed to present a list of tax expenditures for continuation by the Legislature.

PART O proposed to increase the cigarette tax from 74 cents to $1.00 per pack and reduce the amount of the increase that licensed distributors retain.

PART P proposed to increase the sales tax on prepared food from 5% to 7% and amend the definition of prepared food.

PART Q proposed to restrict the high-technology investment tax credit to computer hardware and software activities and the provision of Internet access and advanced telecommunications services.

PART R proposed to:

1. Repeal the sawmill biomass tax credit;

2. Authorize the carrying forward of balances within certain General Fund programs within the Department of Administrative and Financial Services;

3. Recognize General Fund revenue from the recovery of reserve for accounts receivable; and

4. Recognize General Fund revenue from the sale of the Maine Criminal Justice Academy.

PART S proposed to authorize the transfer of up to $150,000 of unencumbered General Fund balances in the Harness Racing Commission program in the Department of Agriculture, Food and Rural Resources to the Harness Racing Promotional Fund, Other Special Revenue account.

PART T proposed to:

1. Repeal the Trust Fund for a Healthy Maine;

2. Repeal the working capital advance from the Trust Fund for a Healthy Maine to the Maine Rx Program;

3. Require the State Treasurer to transfer the balance remaining in the Trust Fund for a Healthy Maine to the General Fund on June 30, 2001;

4. Transfer to the General Fund a portion of the estimated year-end balances remaining as of June 30, 2002 and June 30, 2003 in the Fund for a Healthy Maine;

5. Transfer a portion of the estimated balance remaining available in the fund from the Fund for a Healthy Maine to the General Fund as a result of unexpended balances as of June 30, 2001;

6. Transfer unexpended funds in the Tobacco Prevention and Control, Other Special Revenue account in the Department of Human Services, Bureau of Health to the General Fund. These funds are not from the Fund for a Healthy Maine;

7. Deallocate the amounts allocated to the biennial reserve to make it available within the Fund for a Healthy Maine; and

8. Deallocate amounts that will not be expended during fiscal year 2000-01 from allocations from the Fund for a Healthy Maine so that they are available for transfer to the General Fund pursuant to section 10 of this Part.

PART U proposed to transfer an available balance in the Federal Expenditures Fund Maximus Fund program to the General Fund. It proposed to clarify that revenue from the hospital assessment collected by the Bureau of Revenue Services and transferred to the Department of Human Services would be deposited as General Fund undedicated revenue and lapse to the General Fund balances related to the hospital assessment in the Department of Human Services.

PART V proposed to provide a General Fund appropriation for the demolition of the State Prison in Thomaston.

PART W proposed to authorize a balance in the Education in Unorganized Territory account within the Department of Education to lapse to the General Fund in fiscal year 2001-02.

PART X proposed to establish the Tourism Marketing Promotion Fund within the Department of Economic and Community Development and dedicate a portion of meals and lodging tax collections to this fund to fund the Office of Tourism program.

PART Y proposed to adjust appropriations for the Low-cost Drugs for Maine's Elderly program and proposed to provide funding to establish the Healthy Maine Prescription Program.

House Amendment "A" to Committee Amendment "A" (H-60)

This amendment proposed to remove that part that provides for the closing of state liquor stores.

House Amendment "B" to Committee Amendment "A" (H-61)

This amendment proposed to remove language closing the state liquor stores. It also proposed to transfer funds from the Maine Rainy Day Fund to offset the cost of not closing the state liquor stores.

House Amendment "C" to Committee Amendment "A" (H-62)

This amendment proposed to remove funding for the fingerprinting and background checks of teachers and educational personnel.

House Amendment "D" to Committee Amendment "A" (H-63)

This amendment proposed to remove the Part of the committee amendment that raised the tax on cigarettes.

House Amendment "E" to Committee Amendment "A" (H-64)

This amendment proposed to establish one regional distribution center for liquor in each of the 16 counties of the State.

House Amendment "F" to Committee Amendment "A" (H-65)

This amendment proposed to:

1. Transfer $500,000 from the Maine Rainy Day Fund to the General Fund;

2. Deappropriate funding provided for the demolition of the Maine State Prison in Thomaston; and

3. Provide funding for the federal match for a 3% cost-of-living adjustment for nursing facilities.

House Amendment "G" to Committee Amendment "A" (H-66)

This amendment proposed to:

1. Strike Part M of the committee amendment, which provides for the closing of state liquor stores;

2. Transfer funds from the Abandoned Property Fund that result from the liquidation of securities held in excess of 3 years; and

3. Deappropriate funds from the Maine Learning Technology Endowment to the General Fund.

House Amendment "H" to Committee Amendment "A" (H-67)

This amendment proposed to increase the State's share of general purpose aid for local schools to reach the statutory intent of 55% of education costs.

House Amendment "I" to Committee Amendment "A" (H-68)

This amendment proposed to repeal the law requiring background checks and fingerprinting of school employees. This amendment also proposed to correct cross-references to the repealed provisions.

This amendment also proposed to remove funding for the fingerprinting and background checks of teachers and educational personnel.

House Amendment "J" to Committee Amendment "A" (H-69)

This amendment proposed to increase funding for General Purpose Aid for Local Schools to "hold harmless" those local school districts that lost funding so that they are funded at the same level as in fiscal year 2000-01. This amendment proposed to transfer the funds for this increase from the Maine Learning Technology Endowment.

House Amendment "K" to Committee Amendment "A" (H-70)

This amendment proposed to increase funding for General Purpose Aid for Local Schools to "hold harmless" those local school districts that lost funding so that they are funded at the same level as in fiscal year 2000-01. This amendment also proposed to transfer the funds for this increase from the Maine Rainy Day Fund.

House Amendment "L" to Committee Amendment "A" (H-71)

1. Proposed to strike the increase in taxes on cigarettes and prepared foods proposed in the committee amendment.

2. Proposed to strike the restriction on the high-technology investment tax credit and repeal the sawmill biomass tax credit proposed in the committee amendment.

3. Proposed to strike the Tourism Marketing Promotion Fund created in Committee Amendment "A" because the source of the funding was the increase in taxes on prepared foods.

4. Proposed to increase funding for general purpose aid to local schools by $20,000,000 in fiscal year 2001-02 and $25,000,000 in fiscal year 2002-03.

5. Proposed to reduce the appropriations to all state departments and agencies by 5% except for the following accounts: General Purpose Aid to Local Schools, Education in the Unorganized Territory, Debt Service, Teacher Retirement, General Assistance and Medical Care - Payments to Providers. Proposed to place a hiring freeze on all departments and agencies except for those personnel determined by the Governor to be essential to the safety, care and welfare of the people of Maine.

6. Proposed a cost-of-living adjustment to nursing home workers and nursing home residents.

7. Proposed to prohibit the State from paying for any portion of health care coverage provided to unmarried partners of employees of the State.

House Amendment "M" to Committee Amendment "A" (H-72)

This amendment proposed to provide additional funds for a cost-of-living adjustment for nursing facilities to partially offset funds deappropriated and deallocated in Part B of Committee Amendment "A."

House Amendment "N" to Committee Amendment "A" (H-91)

This amendment proposed to provide a 2nd tier of cushion funding for general purpose aid. The cushion is in addition to any other 2nd tier cushion that may be provided by law. Funding from the cushion would not be available to any school administrative unit that receives more than $400,000 in adjustments to component funding.

House Amendment "O" to Committee Amendment "A" (H-576)

This amendment proposed to amend Part M of the Part I budget, which proposed to close all 27 state liquor stores. This amendment proposed to close 17 stores and maintained 10 to be operated by the Department of Administrative and Financial Services, Bureau of Alcoholic Beverages and Lottery Operations as regional wholesale and retail distribution centers. Under this amendment, the Department of Public Safety, Bureau of Liquor Enforcement is authorized to license 6 agency stores in municipalities with a population in excess of 20,000 where a state store has been closed and 3 agency stores in municipalities with a population less than 20,000 where a state store has been closed. It also proposed to provide assistance for state employees laid off as a result of the closing of 17 state liquor stores.

House Amendment "P" to Committee Amendment "A" (H-607)

This amendment proposed to:

1. Remove Part H, which authorized transfers from the Maine Rainy Day Fund, allowed the General Fund to retain interest earned on that fund and increased the transfers to the fund for 2 fiscal years; Part M, which proposed to close state liquor stores; Part O, which increased the cigarette tax; and Part P, which increased the sales tax on prepared food.

2. Reduce the appropriations to all state departments and agencies by 5% except for the following accounts: General Purpose Aid for Local Schools, Education in the Unorganized Territory, Debt Service, Teacher Retirement, General Assistance and Medicaid programs and any accounts under the Maine Maritime Academy, the Maine Technical College System and the Legislature. It also proposed to place a hiring freeze on all departments and agencies except for those personnel determined by the Governor to be essential to the safety, care and welfare of the people of Maine.

3. Transfer $35,000,000 from the Maine Learning Technology Endowment to the General Fund.

4. Establish a 3% cost-of-living adjustment to nursing home workers and residents.

5. Increase funding for the General Purpose Aid for Local Schools account to "hold harmless" those local school districts that lost funding so that they are funded at the same level as in fiscal year 2000-01.

6. Increase the percentage of state-municipal revenue sharing to 5.2% from 5.1% beginning January 1, 2003.

7. Restore funding for certain child care services.

8. Restrict reimbursement of property taxes under the business equipment tax reimbursement program if the taxes also are reimbursed under a tax increment financing district agreement. Effective for property tax years beginning on or after April 1, 2003, reimbursement under the BETR program is limited to 75% of taxes paid.

9. Require that military retirement benefits are not subject to the offset for social security and railroad retirement benefits effective for tax years beginning on or after January 1, 2001. In the same Part, this amendment also proposed to correct a conflict created by Public Law 1999, chapters 708 and 731, each of which enacted a new Maine Revised Statutes, Title 36, section 5122, subsection 2, paragraph M. This amendment also proposed to resolve the conflict by reallocating one of the new paragraphs to be the Maine Revised Statutes, Title 36, section 5122, subsection 2, paragraph N.

10. Add a delayed closure of the state liquor stores. It directed the Department of Administrative and Financial Services to close 8 state liquor stores by December 31, 2001 and an additional 6 stores no sooner than June 1, 2002, but not later than December 31, 2002 and established a commission to develop a plan to implement an appropriate statewide liquor distribution system.

11. Provide funds for the new classifications and pay ranges for Department of Corrections staff.

12. Set aside funds in the General Fund salary plan for collective bargaining agreements.

13. Provide funds to reduce the unfunded liability for retiree health insurance.

House Amendment "Q" to Committee Amendment "A" (H-609)

This amendment proposed to deappropriate all General Fund funding for the Forum Francophone and appropriate $75,000 per year for fiscal years 2001-02 and 2002-03 to support the employment and economic development activities of Spanish-speaking people in the State.

House Amendment "R" to Committee Amendment "A" (H-610)

This amendment proposed to increase general purpose aid to local schools by 3% in fiscal year 2003 and require the Department of Human Services to adopt rules increasing the amount of income that may be retained by residents of nursing and residential care facilities.

Senate Amendment "A" to Committee Amendment "A" (S-25)

This amendment proposed to restore funds deallocated for child care initiatives and pays for this cost with cuts in the legislative budget.

Senate Amendment "B" to Committee Amendment "A" (S-26)

This amendment proposed to provide funding for an increased cushion to eligible local school administrative units. The cost of the increased cushion is funded through a transfer from the Maine Learning Technology Endowment.

Senate Amendment "C" to Committee Amendment "A" (S-27)

This amendment proposed to remove the cap on military pension benefits, thus allowing them to be fully deductible from the state income tax.

2. Deappropriate funding provided for the demolition of the Maine State Prison in Thomaston; and

Senate Amendment "H" to Committee Amendment "A" (S-32)

Senate Amendment "I" to Committee Amendment "A" (S-34)

This amendment proposed to remove Part P, which increased the sales tax on prepared food, and fund the cost from a transfer from the Maine Rainy Day Fund. This amendment also proposed to eliminate Part X, but provide the same additional funding for tourism promotion in fiscal year 2002-03 as the committee amendment by providing a General Fund appropriation to tourism.

Senate Amendment "J" to Committee Amendment "A" (S-35)

This amendment proposed to appropriate $75,000 in each year of the biennium to the Forum Francophone Des Affaires. This amendment also expressed the intent of the Legislature that such legislative funding would not continue beyond the end of fiscal year 2002-03 without affirmative action by the Legislature.

Senate Amendment "K" to Committee Amendment "A" (S-36)

This amendment proposed to:

1. Strike from the committee amendment Part M, which closed the state liquor stores, Part O, which increased the cigarette tax, Part P, which increased the sales tax on prepared food, Part V, which provided for the demolition of the Maine State Prison in Thomaston and Part X, which established the Tourism Marketing Promotion Fund.

2. Provide funds for a 3% cost-of-living adjustment for nursing facilities.

3. Provide funding for a 2nd tier of cushion funding for general purpose aid for local schools. This amendment also provided for the transfer of unobligated balances from general purpose aid for local schools and the Maine Rainy Day Fund to the General Fund.

4. Increase the percentage of state-municipal revenue sharing to 5.2% from 5.1% beginning July 2002 and provide an $800,000 appropriation for state-municipal revenue sharing in fiscal year 2001-02. It also required Verizon to transfer $5,000,000 from the School and Library Network project to the Maine Learning Technology Endowment. The amendment also transferred $5,000,000 from the Maine Learning Technology Endowment to the General Fund to offset the costs of this amendment.

5. Provide additional appropriations for infant, toddler and preschool child care subsidies, school-aged child care subsidies and full-day, year-round Head Start programs to offset deallocations from Part B.

6. Appropriate $75,000 in each year of the biennium to the Forum Francophone Des Affaires. This amendment also expressed the intent of the Legislature that such legislative funding would not continue beyond the end of fiscal year 2002-03 without affirmative action by the Legislature.

7. Require the Department of Administrative and Financial Services to close 5 state liquor stores by December 31, 2001 and established a commission to develop a plan to implement the closure of the remaining state liquor stores by December 31, 2002. The department is directed to close the remaining state liquor stores no sooner than June 1, 2002 but not later than December 31, 2002.

8. Amend the law that provides for reimbursement by the State of certain property taxes paid by businesses. Certain property is currently excluded from the BETR program, and, with these changes, certain additional property will be excluded on a prospective basis.

9. Transfer $2,000,000 from the Abandoned Property Fund resulting from the liquidation of securities held in excess of 3 years to the unappropriated surplus of the General Fund.

10. Establish a funding mechanism for the demolition of the Maine State Prison in Thomaston.

11. Remove the cap on military pension benefits, thus allowing them to be fully deductible from the state income tax. In the same part, this amendment also corrected a conflict created by Public Law 1999, chapters 708 and 731, each of which enacted a new Maine Revised Statutes, Title 36, section 5122, subsection 2, paragraph M. This amendment resolved the conflict by reallocating one of the new paragraphs to be the Maine Revised Statutes, Title 36, section 5122, subsection 2, paragraph N.

12. Establish the Maine Learning Technology Endowment within the Maine Rainy Fund to consist of no more than $50,000,000, which is the amount of the principal of the original endowment. Interest earned on that segregated amount must be transferred to the Maine Learning Technology Endowment Fund to accomplish the purposes of the Maine Revised Statutes, Title 20-A, Part 9.

13. Provide the same additional funding for tourism promotion in fiscal year 2002-03 as the committee amendment by providing a General Fund appropriation to tourism.

Senate Amendment "L" to Committee Amendment "A" (S-43)

This amendment proposed to:

1. Strike from the committee amendment Part M, which closed the state liquor stores, and replaced it with a delayed closure of the state stores. It directs the Department of Administrative and Financial Services to close 8 state liquor stores by December 31, 2001 and an additional 6 stores no sooner than June 1, 2002, but not later than December 31, 2002, and establishes a commission to develop a plan to implement an appropriate statewide liquor distribution system.

It provided that military retirement benefits are not subject to the offset for social security and railroad retirement benefits. 5. Transfer $51,500,000 from the Maine Learning Technology Endowment to the General Fund. The amendment appropriated $2,300,000 to the endowment to implement a portion of the plan and required the Commissioner of Education to report back to the Legislature on the effectiveness of the technology expenditures. It also required Verizon to transfer $2,000,000 from the School and Library Network project to the Maine Learning Technology Endowment.

6. Replace Part C and provided funding for a 2nd tier of cushion funding for general purpose aid for local schools. This amendment also provided for the transfer of unobligated balances from general purpose aid for local schools and the Maine Rainy Day Fund to the General Fund.

7. Double the amount of budgeted savings from projected vacancies to realize an additional $2,000,000 per year in personal services savings.

8. Transfer to the General Fund the estimated remaining balance in the Fund for a Healthy Maine at the end of fiscal year 2002-03. To address the cash flow needs of the programs funded from the Fund for a Healthy Maine, the amendment authorized a working capital advance from the General Fund to avoid delays in program implementation until the April 2004 Tobacco Settlement Payment is received. Fiscal year 2003-04 is the first year when no January payment is scheduled.

9. Provide funds for a 3% cost-of-living adjustment for nursing facilities.

10. Replace Part V, which provided for the demolition of the Maine State Prison in Thomaston as an appropriation. Instead, the amendment funded the demolition through the use of lapsed balances, or the Maine Rainy Day Fund if lapsed balances are insufficient to fund the cost.

11. Replace Part X, which established the Tourism Marketing Promotion Fund that was funded through an increase of the tax on prepared foods. A similar proposal is implemented, dedicating 7% of the tax on meals and lodging taxed at 7% to generate approximately the same amount of revenue for tourism promotion as the committee amendment.

12. Provide additional appropriations for infant, toddler and preschool child care subsidies, school-aged childcare subsidies and full-day, year-round Head Start programs to offset deallocations from Part B.

4. Increase the percentage of state-municipal revenue sharing to 5.2% from 5.1% beginning January 2003.

5. Transfer $51,500,000 from the Maine Learning Technology Endowment to the General Fund. The amendment appropriated $2,300,000 to the endowment to implement a portion of the plan and required the Commissioner of Education to report back to the Legislature on the effectiveness of the technology expenditures. It also required Verizon to transfer $2,000,000 from the School and Library Network project to the Maine Learning Technology Endowment.

6. Replace Part C and it provide funding for a 2nd tier of cushion funding for general purpose aid for local schools. This amendment also provided for the transfer of unobligated balances from general purpose aid for local schools and the Maine Rainy Day Fund to the General Fund.

7. Double the amount of budgeted savings from projected vacancies to realize an additional $2,000,000 per year in personal services savings.

8. Transfer to the General Fund the estimated remaining balance in the Fund for a Healthy Maine at the end of fiscal year 2002-03. To address the cash flow needs of the programs funded from the Fund for a Healthy Maine, the amendment authorized a working capital advance from the General Fund to avoid delays in program implementation until the April 2004 Tobacco Settlement Payment is received. Fiscal year 2003-04 is the first year when no January payment is scheduled.

9. Provides funds for a 3% cost-of-living adjustment for nursing facilities.

10. Replace Part V, which provided for the demolition of the Maine State Prison in Thomaston as an appropriation. Instead, the amendment funded the demolition through the use of lapsed balances, or the Maine Rainy Day Fund if lapsed balances are insufficient to fund the cost.

11. Replace Part X, which established the Tourism Marketing Promotion Fund that was funded through an increase of the tax on prepared foods. A similar proposal is implemented, dedicating 7% of the tax on meals and lodging taxed at 7% to generate approximately the same amount of revenue for tourism promotion as the committee amendment.

12. Provide additional appropriations for infant, toddler and preschool child care subsidies, school-aged childcare subsidies and full-day, year-round Head Start programs to offset deallocations from Part B.

13. Appropriate $75,000 in each year of the biennium to the Forum Francophone Des Affairs. This amendment also expressed the intent of the Legislature that such legislative funding would not continue beyond the end of fiscal year 2002-03 without affirmative action by the Legislature.

14. Transfer $2,000,000 from the Abandoned Property Fund resulting from the liquidation of securities held in excess of 3 years to the unappropriated surplus of the General Fund.

Senate Amendment "N" to Committee Amendment "A" (S-256)

This amendment proposed to:

1. Strike from the committee amendment Part M, which closed the state liquor stores, and replaced it with a delayed closure of the state stores. It directed the Department of Administrative and Financial Services to close 8 state liquor stores by December 31, 2001 and an additional 6 stores no sooner than June 1, 2002, but not later than December 31, 2002, and established a commission to develop a plan to implement an appropriate statewide liquor distribution system.

2. Eliminate Part O, which increased the cigarette tax, and Part P, which increased the sales tax on prepared food.

3. Replace Part C and provide additional funding for the first tier of cushion and new funding for a 2nd tier of cushion for general purpose aid for local schools.

4. Lapse $4,000,000 from the General Fund salary plan program at the close of fiscal year 2000-01.

5. Transfer $12,000,000 to the General Fund from the estimated remaining balance in the Fund for a Healthy Maine at the end of fiscal year 2002-03. 10. Provide funds for the Department of Human Services to increase wages and benefits for nonadministrative personnel employed in nursing facilities and home care agencies.

11. Provide funds for the Department of Mental Health, Mental Retardation and Substance Abuse Services to increase payments for wages and benefits for direct care personnel employed by certain agencies providing mental health and mental retardation services to adults and children.

12. Clarify the application of the high-technology investment tax credit and makes changes to limitations on the credit.

13. Provide a working capital advance of $1,700,000 from the Fund for a Healthy Maine to provide start-up funds for the Maine Rx Program and allocates funds to implement the Maine Rx Program.

14. Require the Medicaid reimbursement rate for routine home care under the hospice program to be set at the Medicare rate plus 23% beginning April 1, 2002.

15. Provide ongoing funds for the Maine Hospice Council to support volunteer hospice programs.

16. Provide that military retirement benefits are not subject to the offset for social security and railroad retirement benefits effective for tax years beginning on or after January 1, 2001. In the same Part, this amendment also corrected a conflict created by Public Law 1999, chapters 708 and 731, each of which enacted a new Maine Revised Statutes, Title 36, section 5122, subsection 2, paragraph M. This amendment resolved the conflict by reallocating one of the new paragraphs to be the Maine Revised Statutes, Title 36, section 5122, subsection 2, paragraph N.

17. Revise the hospital assessment revenue projections to reflect a recent acceptance of an offer in compromise.

18. Remove amounts reserved for the Healthy Maine Prescription Program, L.D. 1790, Public Law 2001, chapter 293.

19. Appropriate $75,000 in each year of the biennium to the Forum Francophone Des Affairs. This amendment also expressed the intent of the Legislature that such legislative funding will not continue beyond the end of fiscal year 2002-03 without affirmative action by the Legislature.

20. Amend the laws related to the Maine Learning Technology Endowment. It transferred $20,000,000 of the original amount appropriated to the Maine Learning Technology Endowment, plus an estimated $3,000,000 in interest income earned from the investment of the $50,000,000 in the endowment by August 1, 2001, to the General Fund. It required the State to raise a minimum of $15,000,000 in contributions from nonstate sources by January 8, 2003 in order to establish the endowment. Failure of the State to raise these contributions from nonstate sources by this date will result in the removal of the limitation on the endowment principal in implementing the learning technology plan in fiscal years 2002-03 to 2005-06. It stipulated that the principal and income of the endowment may not be used to implement the fundraising plan. It allowed limited use of the initial principal to ensure timely start-up and implementation of Phase I of the task force plan. It established a mechanism to allow donors to redirect their contributions to the endowment if the State fails to raise sufficient contributions by January 8, 2003.

21. Lapse $512,384 of balances available within the Department of Administrative and Financial Services resulting from savings in the amounts appropriated from the renovation of the State Office Building.

22. Recognize General Fund savings in the Temporary Assistance to Needy Families program as a result of a recognition of the State's share of child support collections earned but not yet transferred.

Senate Amendment "O" to Committee Amendment "A" (S-260)

This amendment proposed to require individual and group health insurance policies to provide coverage for hospice care services to persons who are terminally ill. The amendment applied to all policies issued or renewed on or after January 1, 2002.

It also proposed to require the Department of Human Services, Bureau of Health to solicit grants and funding from other outside funding sources to establish and operate the Maine Center for End-of-life Care and proposed to require that the center be hosted by an educational institution, professional association or other entity interested in the care of the terminally ill.

It proposed to require the Department of Professional and Financial Regulation, Office of Licensing and Registration to compile a report on the current entry-level and continuing educational requirements related to end-of-life care issues for licensed health care professions.

It proposed to require the Maine Health Data Organization to gather baseline data and standardized assessment tools regarding end-of-life care within the organization's existing database.

Committee Amendment "A" (H-320) proposed to appropriate $25,000 in each year of the biennium to the Department of Education to grant funds to certain teachers seeking certification from the National Board for Professional Teaching Standards. The funds would be appropriated as a state match with federal and University of Maine System funds. Committee Amendment "A" (H-87), the majority report of the Joint Standing Committee on Judiciary, proposed to replace the bill with a resolve to create the Commission on Fatherhood Issues consisting of 11 members appointed by the President of the Senate and the Speaker of the House of Representatives. The resolve proposed that the commission study issues concerning the barriers to being an involved father in Maine.

House Amendment "A" (H-362) proposed to strike the emergency preamble and the emergency clause and changes the dates by which appointments must be made to the Commission on Fatherhood Issues, the first meeting convened and the commission's report submitted.

PART I proposed to establish the Land Management Fund within the Department of Inland Fisheries and Wildlife. This Part also proposed to authorize certain carrying balances within the Inland Fisheries and Wildlife program to lapse to the General Fund.

PART J proposed to amend the law to create a Deputy Commissioner position within the Department of Mental Health, Mental Retardation and Substance Abuse Services.

PART K proposed to authorize the Governor Baxter School for the Deaf to transfer available balances of appropriations and allocations between line categories by financial order and authorize the extension of a limited-period position to June 30, 2002.

PART L proposed to change the presumptive abandonment period for property related to the demutualization or related reorganization of an insurance company to 2 years. It also proposed to allow the Department of Administrative and Financial Services, Bureau of Revenue Services to share certain information with the Treasurer of State. It also proposed to transfer additional amounts from the Abandoned Property Fund in fiscal year 2001-02 and fiscal year 2002-03.

PART M proposed to authorize the change of bargaining unit from Professional Technical to Supervisory Services for the Senior DNA Forensic Analyst position within the Department of Public Safety, Bureau of State Police. This Part also proposed to authorize the Department of Human Services to fund position upgrades in the Drinking Water program and the Eating and Lodging program and the previously approved upgrade of one Planning and Research Associate position within existing budgeted resources.

PART N proposed to authorize the Maine Governmental Facilities Authority to issue securities up to $5,500,000 for certain courthouse projects.

PART O proposed to eliminate the Office of State Historian program, deappropriate its current funding and provide funding for the Office of State Historian program within the Historic Preservation Commission program. It also proposed to eliminate the nonlapsing funds language.

PART P proposed to fund the Lewiston-Auburn College teachers for elementary and middle schools project through a delay in the Maine Patent Program and provide 2.5% increases in the base budgets for the University of Maine System, the Maine Technical College System and Maine Maritime Academy.

PART P also proposed to authorize transfers from the General Fund Salary Plan to the Maine Technical College System for collective bargaining costs in fiscal year 2001-02 and fiscal year 2002-03.

PART Q proposed to continue an adjustment of headcount that was authorized in Public Law 2001, chapter 1; reflect the number of positions authorized by the Legislative Council to support the activities of the Legislature and the organization of the 120th Legislature; provide sufficient funds in the personal services line category to meet the needs of the current organizational structure of the Legislature; and provide for a line category transfer of funds to establish a position to replace desktop support currently provided by contract.

PART R proposed to fund a celebration of the State House renovations.

PART S proposed to provide additional guidance regarding the 2.5% increase of wages and benefits included in the reimbursement to agencies for mental health and mental retardation services.

PART T proposed to:

1. Contain recommendations of the Committee to Develop a Compensation Program for Victims of Abuse at the Governor Baxter School for the Deaf, created by Resolve 1999, chapter 127, Part B. This Part takes the place of L.D. 271 and L.D. 293.

2. Create the Baxter Compensation Authority, which establishes the Baxter Compensation Program to pay compensation to the former students who were sexually or physically abused while attending the Governor Baxter School for the Deaf or its predecessor, the Maine School for the Deaf. Claims for compensation would need to be submitted by March 31, 2006. All compensation would need to be paid out by July 1, 2007, when the program ceased to exist.

The compensation and costs of the program would be paid from the Baxter Compensation Authority Other Special Revenue Fund account. The amount of $1,000,000 is proposed to be transferred from the Governor Baxter School for the Deaf Student Trust Fund into the account on July 1, 2001. The amount of $2,000,000 is proposed to be transferred from the Maine Rainy Day Fund into the account in fiscal year 2001-02. The amount of $3,000,000 is proposed to be set aside in the Governor Baxter School for the Deaf Compensation Fund within the Maine Rainy Day Fund to be made available by financial order to pay compensation to the victims and to pay administrative costs of the program.

Part U proposed to establish a Statewide Radio and Network System Reserve Fund as an internal service fund within the Department of Administrative and Financial Services for the purpose of replacing the current radio and network system. This Part proposed to require the Chief Information Officer of the Department of Administrative and Financial Services to prepare a report to specified committees of the Legislature on all activities of the radio and network system. This Part also proposed to provide lease-purchase authorization for the acquisition of hardware and software for the radio and network system and provides funding for the financing costs.

Part V proposed to clarify the licensing responsibilities for new agency liquor stores and authorize the Department of Public Safety, Bureau of Liquor Enforcement to waive the spacing requirement for agency liquor stores in order to license a sufficient number of agency stores in municipalities to implement this Part.

Part W proposed to transfer $150,000 to the General Fund in fiscal year 2001-02 from available balances in an account within the Department of the Attorney General designated for the legal expenses involved with the defense of the boundary dispute with New Hampshire. Part W also proposed to transfer $2,550,000 from the Department of Professional and Financial Regulation, Securities Division to the General Fund in fiscal year 2001-02.

PART X proposed to:

1. Repeal the child welfare services ombudsman, a position in the Executive Department that has not been funded in years.

2. Establish an ombudsman program within the Executive Department through contract with an independent nonprofit organization. Ombudsman services will be provided by one ombudsman and one support staff.

3. Provide that the duties of the ombudsman include serving the children and families with regard to child welfare services provided by the Department of Human Services.

4. Provide for penalties for persons who intentionally interfere with the performance of the ombudsman's duties and for persons who penalize or impose restrictions on a person who makes a complaint or inquiry to the ombudsman.

5. Require a report in January 2003 regarding combining other advocacy and ombudsman functions within the Department of Education, the Department of Human Services, the Department of Mental Health, Mental Retardation and Substance Abuse Services, the Department of Corrections and the Disability Rights Center.

6. Provide funding for 18 new caseworkers, 3 supervisors, one Division Director and 2 Program Administrator - Child Protective positions in child welfare services in the Department of Human Services, increases funding for travel and cellular phone time and provides funding for laptop computers.

7. Transfer $4,043,531 from the Department of Human Services, Child Support Collections, Other Special Revenue account representing a portion of the State's share of child support collections earned but not transferred to the Temporary Assistance for Needy Families, Other Special Revenue account and provides for a corresponding General Fund deappropriation due to the availability of one-time funds from child support collections.

PART Y proposed to provide funds for the Department of Human Services for the completion of Phase I and for Phase II and Phase III of the Claims Management System.

PART Z proposed to establish the Sexual Assault Forensic Examiner Advisory Board within the Department of the Attorney General. It also proposed to appropriate funds for the sexual assault forensic examiner program and for the new violence against women initiative in the Department of Public Safety.

PART AA proposed to authorize a tax anticipation note of up to $100,000,000 for fiscal year 2001-02 and provides a General Fund appropriation to cover the debt service costs associated with that note.

PART BB proposed to amend Public Law 1999, chapter 731 to provide that funds of the Maine Fire Protection Services Commission do not lapse but must be carried forward until June 30, 2002.

PART CC proposed to allocate funds on a one-time basis from the Dam Repair and Reconstruction Fund for a low-flow study to be conducted by the Aroostook Water and Soil Management Board.

PART DD proposed to provide a 5% increase in the maximum level of assistance in the Temporary Assistance for Needy Families program effective October 1, 2001.

PART DD also proposed to include offsetting allocations and deallocations of $750,000 in fiscal year 2001-02 and $1,000,000 in fiscal year 2002-03 to reflect the requirement that the Department of Human Services use unexpended TANF block grant funds to support a portion of the 5% increase in the maximum level of assistance.

PART EE proposed to deallocate funds to the Public Advocate within the Executive Department in order to limit growth within the Office of the Public Advocate.

PART FF proposed to set up a priority of transfers from unappropriated surplus at the close of fiscal year 2000-01.

PART GG proposed to authorize the issuance of complimentary hunting and fishing licenses to resident active military personnel.

PART HH proposed to:

1. Establish a summer "fill" program to provide low-income households that are eligible for fuel assistance through the Low-income Home Energy Assistance program, LIHEAP, with an initial supply of fuel and authorizes a $10,000,000 working capital advance from the General Fund beginning in fiscal year 2002-03.

2. Require the Maine State Housing Authority to study fixed-price home heating fuel contracts for fuel assistance recipients.

3. Require the Maine State Housing Authority to identify the most effective way to provide adequate funding of the anticipated 25% nonfederal share of the weatherization program.

4. Require the Maine State Housing Authority to investigate the possibility of establishing a separate Office of Energy Conservation within the Maine State Housing Authority.

5. Require the Maine State Housing Authority to annually investigate the possibility of increasing the percentage of LIHEAP funds for weatherization services.

6. Require the State Planning Office to conduct a study to determine whether the State can reduce its per capita residential energy consumption by 25% by 2011.

PART II proposed to expand the eligibility for the elderly low-cost drug program by adding over-the-counter medications that are prescribed by a health care provider and approved as cost-effective by the Department of Human Services as a basic component of the elderly low-cost drug program. This Part also proposed to establish income eligibility for the elderly low-cost drug program at 185% of the federal nonfarm income poverty line as adjusted to match the annual cost-of-living increases in social security retirement benefits.

PART JJ proposed to exempt from use tax merchandise that is donated to an exempt organization.

PART KK proposed to appropriate funds to support outreach activities at the Beals Island Regional Shellfish Hatchery.

PART LL proposed to provide an income tax deduction for compensation paid to victims of the Holocaust and their survivors.

PART MM proposed to require the Department of Human Services to adopt rules that take effect on January 1, 2002 to increase the amount of reimbursement under the Medicaid program for occupational and physical therapy, speech and language pathologist and audiologist services to 50% of the usual and customary charge.

PART NN proposed to provide a General Fund appropriation to the Department of Education for the Interdepartmental Committee on Transition, the department's training and technical assistance arm on mandated transition issues. The funds will be used to ensure that all youth, parents, school districts and agencies dealing with transition in this State have access to the Interdepartmental Committee on Transition's services including information disseminating, training, capacity building for systems change, youth leadership and advocacy.

PART OO proposed to direct the Department of Conservation to work with the United States Army Corps of Engineers to modify the federal coastal engineering structure at Camp Ellis in Saco. It also proposed to direct the department to develop a beach nourishment policy for the State.

PART PP proposed to increase the percentage transferred to the Local Government Fund from 5.1% to 5.2% for 6 months beginning January 1, 2003.

PART QQ proposed to increase the contribution for health insurance for retired teacher members from 30% to 35% beginning July 1, 2002. In addition, the amendment proposed to indicate that eligible retired teachers must have 5 years of creditable service to be eligible for the state contribution to the health insurance benefit.

PART RR proposed to reinstate emergency assistance for veterans.

PART SS proposed to provide a General Fund appropriation of $300,000 to the Maine Science and Technology Foundation to be used as the state match requirement for the Maine Experimental Program to Stimulate Competitive Research, a federal and state partnership that builds research infrastructure in states. This amendment also proposed to establish the Maine EPSCoR Capacity Fund to be used to match successful EPSCoR awards.

PART TT proposed to provide one-time funds to encourage private donations to the Maine Maritime Academy's Small Vessel Endowment Fund and require the Academy to raise private contributions on a 2-for-1 basis to supplement the appropriation.

PART UU proposed to direct the Department of Human Services to grant Medicaid eligibility to women who have been diagnosed with breast or cervical cancer under the State's early detection program.

PART VV proposed to designate as public assistance aid provided to veterans and their dependents pursuant to the Maine Revised Statutes, Title 37-B and require that the Department of Defense, Veterans and Emergency Management retain administrative responsibility for this aid.

PART VV also proposed to provide funding for support staff positions in the Department of Defense, Veterans and Emergency Management, Bureau of Veterans' Services regional field offices.

PART WW proposed to implement certain recommendations of the Judicial Compensation Commission established by the Maine Revised Statutes, Title 4, chapter 35. The purpose of implementing this Part is to attract the most highly qualified candidates to the bench by improving the retirement benefits provided to the State's judiciary. Implementation of this Part will increase the maximum benefit from 60% to 70% of average final compensation for judges appointed on or after December 1, 1984.

PART XX proposed to provide funds to allow Maine to continue its membership in the Northeast States Association for Agricultural Stewardship.

PART YY proposed to permit foster parents to purchase group health insurance through the state employee health insurance plan.

PART ZZ proposed to appropriate ongoing funds to establish 4 new Jobs for Maine's Graduates' sites for the biennium.

PART AAA proposed to provide funds for the High Hopes Clubhouse to allow for the continuation of its Waterville operations.

PART BBB proposed to provide funds for the State's share of the budget to operate the Northeast Legislative Association on Prescription Drug Pricing.

PART CCC proposed to establish the Community Health Access Program within the Department of Human Services and provides for one Social Services Program Manager position to administer the program, effective July 1, 2002.

PART DDD proposed to specify the manner of calculation of rate of return for nonprofit nursing facilities beginning February 1, 2002, contingent on approval of Medicaid funding at the federal level.

PART EEE proposed to implement the recommendations of the Judicial Compensation Commission regarding per diem compensation.

PART FFF proposed to provide funds to improve the services of the Saco River Corridor Commission.

PART GGG proposed to provide a General Fund appropriation of $25,000 in fiscal year 2002-03 to the Department of Education to grant funds to certain teachers seeking certification from the National Board for Professional Teaching Standards. These funds are appropriated as a state match with federal and University of Maine System funds. This appropriation is intended to provide reimbursement for only those teachers that become certified. Individual grants issued by the Maine Leadership Consortium may not exceed $2,300 per teacher.

PART HHH proposed to provide funds from the Fund for a Health Maine to continue the Donated Dental Services program.

PART III proposed to appropriate funds to the Maine Technical College System for the programs and operation of the Bath Higher Education Center.

PART JJJ proposed to exempt certain organizations from the meals and lodging tax.

PART KKK proposed to provide a General Fund appropriation to the Department of Labor for Catholic Charities Maine to support a portion of the cost of 2 additional Teacher of Blind and Visually Impaired Children positions and related costs.

PART LLL proposed to clarify the duties of the Department of Mental Health, Mental Retardation and Substance Abuse Services regarding reporting the need for children's crisis services and allocates those duties to the Maine Revised Statutes.

PART MMM proposed to provide a General Fund appropriation of $67,000 annually in fiscal years 2001-02 and 2002-03 for the Department of Labor to support a portion of the cost of one new Computer Access Specialist position to provide computer access services through the Iris Network to blind consumers regardless of age or location in the State.

PART NNN proposed to provide General Fund appropriation of $100,000 in fiscal year 2002-03 for the Department of Labor to increase statewide education, training and employment and self-employment services for displaced homemakers. The appropriation would provide for increased staff to provide service delivery in Washington and Waldo counties beginning in fiscal year 2002-03.

PART OOO proposed to provide funds for the Finance Authority of Maine to undertake a study of methods of relieving the shortage of dentists in Maine, including the feasibility of establishing an accredited dental residency program.

PART PPP proposed to amend the Sex Offender Registration and Notification Act of 1999 and sentencing provisions for sex offenders.

PART QQQ proposed to establish a sales tax exemption for certain incorporated, nonprofit memorial foundations.

PART RRR proposed to authorize the Department of Human Services to establish a prescription drug reimportation program contingent upon approval from the federal Department of Health and Human Services and upon cost savings to be realized by Maine citizens as a result of the operation of this program.

PART SSS proposed to provide for the reimbursement to optometrists for services provided to persons whose care is paid for in part by the Medicaid program and in part by the Medicare program.

PART TTT proposed to establish the Education Funding Reform Committee to make recommendations to the Legislature that reduce the State's reliance on the property tax as the primary source of funding for elementary and secondary education and to identify other funding sources that ensure equal educational opportunity, provide a more equitable balance among funding sources and provide property tax relief to encourage businesses to expand and locate to the State and to entice more people to live in the State. The committee is required to make recommendations to the Legislature by December 31, 2001. The Legislature may accept or reject the committee's recommendations or submit the committee's recommendations to the voters at a public referendum at the time of the general election in November 2002. It also provides a General Fund appropriation for the Legislature to support the costs of the commission.

PART UUU proposed to provide additional funds for the Reading Recovery Program.

PART VVV proposed to retroactively amend an appropriation for a school breakfast incentive grant program included in a 1999 supplemental budget to allow unexpended balances in that account to carry forward from year to year to be used for school breakfast incentive grants. Without this retroactive amendment, those unexpended balances would lapse to the General Fund. This part also proposed changes to the standard determining which schools are eligible to participate in the program to that standard originally proposed.

PART WWW proposed to appropriate funds for the Capital Riverfront Improvement District.

PART XXX proposed to provide a General Fund appropriation for the Department of Corrections to support the Building Alternatives Program at the Maine Youth Center in fiscal year 2002-03. It also proposed to require the Department of Corrections to report on a plan to establish a building alternatives program at the Northern Maine Juvenile Facility.

PART YYY proposed to establish the Community Forestry Fund, provides a one-time appropriation to the fund in fiscal year 2001-02 and necessary allocations and ensures continuing revenues for the fund by dedicating to the fund 2.5% of the General Fund portion of real estate transfer tax revenue up to $200,000 annually. The portion of real estate transfer tax revenue dedicated to the fund is reduced by the amount of federal funds received for community forestry. In fiscal year 2001-02 and fiscal year 2002-03, it is estimated that federal funds will exceed $200,000 annually, so that no real estate transfer tax funds will be required.

PART ZZZ proposed to appropriate funds for the continuance of the state meat inspection program.

PART AAAA proposed to establish the Health Care System and Health Security Board. The board is composed of 19 members. The board is charged with developing a plan to provide health care coverage to all citizens of this State in a manner that emphasizes 24 hour coverage, quality, cost containment, choice of provider and access to comprehensive and long-term care. The board is required to conduct a feasibility study of economic impacts of the plan on individuals and businesses of payment options and to develop proposals for implementation of a plan for universal coverage and access. The board is authorized to contract with a health policy organization for staffing assistance and to accept public and private funding. The board is authorized to introduce legislation to the Second Regular Session of the 120th Legislature.

PART BBBB proposed to establish the Maine Research and Development Evaluation Fund to support the research and development efforts of the Maine Science and Technology Foundation.

PART CCCC proposed to provide funds for a low-barrier homeless teen shelter located in Rockland to serve youth in Knox, Lincoln and Waldo Counties of Region 2.

PART DDDD proposed to provide additional funding for the geographic isolation adjustment within the General Purpose Aid for Local Schools program.

PART EEEE proposed to change the name of the Maine Communities in the New Century Program to the New Century Community Program and provide funding to enhance the preservation and advancement of local cultural resources, promote literacy and access to lifelong learning among children and adults and expand opportunities for cultural tourism.

PART FFFF proposed to authorize implementation of the Enhanced 9-1-1 Emergency System, authorizes a one-year increase in the statewide E-1-1 surcharge and provide additional allocations necessary to implement the program.

PART GGGG proposed to provide funds to include podiatrists in the group of health care providers who are exempt from reimbursement reductions with respect to its liability for Medicare Part B deductible and coinsurance charges.

PART HHHH proposed to remove certain law enforcement officers in the Department of Inland Fisheries and Wildlife and the Department of Marine Resources from the 1998 Special Plan and provide those certain positions with a retirement plan that offers full retirement benefits after 25 years of service with no minimum age requirement. This plan change is to be funded through year-end transfers from the unappropriated surplus of the General Fund to the Retirement Allowance Fund. The effective date of the plan change is dependent upon the balance of the Retirement Allowance Fund and the further action of the Legislature to direct payment of the full actuarial cost of the retirement system.

PART IIII proposed to include a one-time General Fund appropriation to fund a matching grant program that establishes education and training programs for eligible health care businesses and organizations that provide dollar-for-dollar matching funds and meet eligibility criteria established by rules of the Maine Technical College System.

PART JJJJ proposed to appropriate funding for the Maine State Library to purchase on-line reference materials.

PART KKKK proposed to make the following General Fund appropriations: ongoing appropriations of $50,000 each in fiscal years 2001-02 and 2002-03 for operating costs at the Katahdin Area K-Tech Center; an ongoing appropriation of $60,000 in fiscal year 2002-03 to the Maine Technical College System for Western Maine University and Technical College Center operations; a one-time appropriation of $120,000 in fiscal year 2001-02 to the University of Maine System for architectural work at the Western Maine University and Technical College Center; and an ongoing appropriation of $90,000 in fiscal year 2002-03 to the University of Maine System for Western Maine University and Technical College Center operations.

PART LLLL proposed to establish a grant fund in the Department of Conservation to assist foresters with the costs of obtaining certain certifications. This Part also proposed to provide appropriations and allocations necessary to administer this program.

PART MMMM proposed to establish and fund the Maine Port Terminal Facilities Marketing Program.

PART NNNN proposed to require the Commissioner of Education to pay as a supplement to the regular student tuition for unorganized territory students attending school in School Administrative District No. 58 a debt service factor to help fund school construction costs of the school district.

PART OOOO proposed to establish a state purchasing code of conduct for suppliers of apparel, footwear or textiles and provide the Division of Purchases the General Fund appropriations necessary to administer the new provisions.

PART PPPP proposed to raise the debt service limit for school facilities bonds for fiscal year 2005-06 and fiscal year 2006-07.

PART QQQQ proposed to create the Legislative Youth Advisory Council, which is composed primarily of youth and student members, to provide advice to the Legislature on matters relating to youth and appropriates funds for the council.

PART RRRR proposed to establish the Maine Computer Crimes Task Force and appropriates funds to administer the task force.

PART SSSS proposed to authorize the Department of Defense, Veterans and Emergency Management to accept land for a veterans' cemetery in southern Maine. Land accepted by the department must meet all the requirements provided in state laws and rules.

PART TTTT proposed to amend the penalties for late filing of accelerated campaign reporting under the Maine Clean Election Act. It also proposed to provide additional appropriations for increased costs of the Commission on Governmental Ethics and Election Practices and Other Special Revenue Funds allocations for one additional General Counsel position.

PART UUUU proposed to increase the cigarette tax from 74 cents to 94 cents per pack effective September 1, 2001 and reduce the amount of the increase that licensed distributors retain.

PART VVVV proposed to increase the sales tax on prepared food from 5% to 7% and amend the definition of prepared food effective August 1, 2001.

PART WWWW proposed to establish the Tourism Marketing Promotion Fund within the Department of Economic and Community Development and dedicate a portion of meals and lodging tax collections to this fund to fund the Office of Tourism program effective July 1, 2003.

PART XXXX proposed to provide funds for sexual assault and domestic violence intervention and prevention.

PART YYYY proposed to authorize the expenditure of funding among pharmaceutical benefits programs administered by the Department of Human Services.

PART ZZZZ proposed to authorize certain balances to carry forward and makes adjustments to appropriations to reflect the estimated balances that will be carried forward. It also proposed to provide funding for the State House renovation shortfall, legislative studies, the civil rights team project and the Maine Biomedical Research Fund. It also recognized savings in the Department of Economic and Community Development and utilizes some of the TANF reserve funds within the Department of Human Services.

Committee Amendment "B" (H-725)

PART A proposed supplemental appropriations and allocations.

PART B proposed supplemental appropriations and allocations from various governmental funds for approved reclassifications and range changes.

PART C proposed to:

1. Amend the Retiree Health Insurance Internal Service Fund law to clarify investment, audit and use of the fund; and

2. Authorize the State Budget Officer to distribute retiree health insurance costs to affected accounts as appropriation and allocation adjustments.

1. Amend the law as it relates to the definition of "corporation" to ensure that all health maintenance organizations are equitably subjected to the corporate income tax; and

2. Amend the law as it relates to the definition of "compensation" for payroll tax calculation on leased or temporary employees.

1. Amend the law concerning positions to support the design and implementation of the new Budget Management System within the Department of Administrative and Financial Services.

PART F proposed to:

1. Authorize the Department of Administrative and Financial Services to enter into lease-purchase agreements to purchase motor vehicles for the Central Motor Pool;

2 Authorize the Department of Administrative and Financial Services to enter into lease-purchase agreements to purchase hardware, software and systems in support of the operations of State Government; and

3. Authorize the issuance of securities by the Maine Governmental Facilities Authority.

PART G proposed to establish the Office of Victim Services within the Department of Corrections and authorizes the transfer of funds by financial order to pay overtime and labor market adjustments for teachers at the Northern Maine Juvenile Facility. Part G also authorizes the Department of Corrections to establish intermittent positions to avoid unbudgeted overtime. This Part proposed to rename the Southern Maine Juvenile Facility the "Long Creek Youth Development Center" and the Northern Maine Juvenile Facility the "Mountain View Youth Development Center." This Part also proposed to authorize the Department of Corrections to carry forward funds for overtime.

PART H proposed to remove the Federal and State Education Program Coordinator from the list of appointments by the Commissioner of Education. It also proposed to authorize funds to be lapsed from the general purpose aid for local schools account to the General Fund.

PART I proposed to establish the Land Management Fund within the Department of Inland Fisheries and Wildlife. This Part also proposed to authorize certain carrying balances within the Inland Fisheries and Wildlife program to lapse to the General Fund.

PART J proposed to amend the law to create a Deputy Commissioner position within the Department of Mental Health, Mental Retardation and Substance Abuse Services.

PART K proposed to authorize the Governor Baxter School for the Deaf to transfer available balances of appropriations and allocations between line categories by financial order and extend a limited-period position to June 30, 2002.

PART L proposed to change the presumptive abandonment period for property related to the demutualization or related reorganization of an insurance company to 2 years. It also proposed to allow the Department of Administrative and Financial Services, Bureau of Revenue Services to share certain information with the Treasurer of State. It also proposed to transfer additional amounts from the Abandoned Property Fund in fiscal year 2001-02 and fiscal year 2002-03.

PART M proposed to authorize the change of bargaining unit from Professional Technical to Supervisory Services for the Senior DNA Forensic Analyst position within the Department of Public Safety, Bureau of State Police. This Part also proposed to authorize the Department of Human Services to fund position upgrades in the Drinking Water program and the Eating and Lodging program and the previously approved upgrade of one Planning and Research Associate position within existing budgeted resources.

PART N proposed to authorize the Maine Governmental Facilities Authority to issue securities up to $5,500,000 for certain courthouse projects.

PART O proposed to eliminate the Office of State Historian program, deappropriate its current funding and provide funding for the Office of State Historian program within the Historic Preservation Commission program. It also proposed to eliminate the nonlapsing funds language.

PART P proposed to fund the Lewiston-Auburn College teachers for elementary and middle schools project through a delay in the Maine Patent Program and provide 2.5% increases in the base budgets for the University of Maine System, the Maine Technical College System and Maine Maritime Academy.

PART P also proposed to authorize transfers from the General Fund Salary Plan to the Maine Technical College System for collective bargaining costs in fiscal year 2001-02 and fiscal year 2002-03.

PART Q proposed to continue an adjustment of headcount that was authorized in Public Law 2001, chapter 1; reflect the number of positions authorized by the Legislative Council to support the activities of the Legislature and the organization of the 120th Legislature; provide sufficient funds in the personal services line category to meet the needs of the current organizational structure of the Legislature; and provide for a line category transfer of funds to establish a position to replace desktop support currently provided by contract.

PART R proposed funding a celebration of the State House renovations.

PART S proposed to authorize funds to be transferred from the Fund for a Healthy Maine to the General Fund and provide additional deallocations from the Fund for a Healthy Maine.

PART T proposed to:

1. Contain recommendations of the Committee to Develop a Compensation Program for Victims of Abuse at the Governor Baxter School for the Deaf, created by Resolve 1999, chapter 127, Part B. This Part takes the place of L.D. 271 and L.D. 293.

2. Create the Baxter Compensation Authority, which establishes the Baxter Compensation Program to pay compensation to the former students who were sexually or physically abused while attending the Governor Baxter School for the Deaf or its predecessor, the Maine School for the Deaf. Claims for compensation must be filed by March 31, 2006. All compensation must be paid out by July 1, 2007, when the program ceases to exist.

The compensation and costs of the program would be paid from the Baxter Compensation Authority Other Special Revenue Fund account. The amount of $1,000,000 would be transferred from the Governor Baxter School for the Deaf Student Trust Fund into the account on July 1, 2001. The amount of $2,000,000 would be transferred from the Maine Rainy Day Fund into the account in fiscal year 2001-02. The amount of $3,000,000 would be set aside in the Governor Baxter School for the Deaf Compensation Fund within the Maine Rainy Day Fund to be made available by financial order to pay compensation to the victims and to pay administrative costs of the program.

PART U proposed to establish a Statewide Radio and Network System Reserve Fund as an internal service fund within the Department of Administrative and Financial Services for the purpose of replacing the current radio and network system. This Part would require the Chief Information Officer of the Department of Administrative and Financial Services to prepare a report to specified committees of the Legislature on all activities of the radio and network system. This Part also proposed to provide lease-purchase authorization for the acquisition of hardware and software for the radio and network system and provides funding for the financing costs.

PART V proposed to clarify that the Bureau of Liquor Enforcement within the Department of Public Safety is responsible for licensing agency liquor stores and authorizes the Department of Public Safety, Bureau of Liquor Enforcement to waive the spacing requirement for agency liquor stores in order to license a sufficient number of agency stores in municipalities to implement this Part.

PART W proposed to transfer $150,000 to the General Fund in fiscal year 2001-02 from available balances in an account within the Department of the Attorney General designated for the legal expenses involved with the defense of the boundary dispute with New Hampshire to the unappropriated surplus of the General Fund. Part W also proposed to transfer $2,550,000 from the Department of Professional and Financial Regulation, Securities Division to the General Fund in fiscal year 2001-02.

PART X proposed to:

1. Repeal the child welfare services ombudsman, a position in the Executive Department that has not been funded in years.

2. Establish an ombudsman program within the Executive Department through contract with an independent nonprofit organization. Ombudsman services would be provided by one ombudsman and one support staff.

3. Provide that the duties of the ombudsman include serving the children and families with regard to child welfare services provided by the Department of Human Services.

4. Provide for penalties for persons who intentionally interfere with the performance of the ombudsman's duties and for persons who penalize or impose restrictions on a person who makes a complaint or inquiry to the ombudsman.

5. Require a report in January 2003 regarding combining other advocacy and ombudsman functions within the Department of Education, the Department of Human Services, the Department of Mental Health, Mental Retardation and Substance Abuse Services, the Department of Corrections and the Disability Rights Center.

6. Provide funding for 18 new caseworkers, 3 supervisors, one Division Director and 2 Program Administrator - Child Protective positions in child welfare services in the Department of Human Services, increase funding for travel and cellular phone time and provide funding for laptop computers.

7. Transfer $4,043,531 from the Department of Human Services, Child Support Collections, Other Special Revenue account representing a portion of the State's share of child support collections earned but not transferred to the Temporary Assistance for Needy Families, Other Special Revenue account and provide for a corresponding General Fund deappropriation due to the availability of one-time funds from child support collections.

PART Y proposed to provide funds for the Department of Human Services for the completion of Phase I and for Phase II and Phase III of the Claims Management System.

PART Z proposed to establish the Sexual Assault Forensic Examiner Advisory Board within the Department of the Attorney General.

PART AA proposed to authorize a tax anticipation note of up to $100,000,000 for fiscal year 2001-02 and provide a General Fund appropriation to cover the debt service costs associated with that note.

PART BB proposed to amend Public Law 1999, chapter 731 to provide that funds of the Maine Fire Protection Services Commission do not lapse but must be carried forward until June 30, 2002.

PART CC proposed to allocate funds on a one-time basis from the Dam Repair and Reconstruction Fund for a low-flow study to be conducted by the Aroostook Water and Soil Management Board.

PART DD proposed to provide for an across-the-board reduction of approximately 1% to General Fund accounts with some exception for fiscal year 2001-02 and fiscal year 2002-03.

PART EE proposed to deallocate funds to the Public Advocate within the Executive Department in order to limit growth within the Office of the Public Advocate.

PART FF proposed to prioritize transfers from unappropriated surplus at the close of fiscal year 2000-01.

PART GG proposed to amend the law to provide for the closing of all state-operated liquor stores.

House Amendment "A "to Committee Amendment "A" (H-730)

This amendment proposed to direct the State Fire Marshal to negotiate a bulk purchase price for thermal imaging cameras to be purchased by local fire-fighting units and law enforcement agencies. The purchase may be furthered by means of a low-interest loan administered by the Commissioner of Public Safety from the Thermal Imaging Camera Fund. It also proposed to add appropriation and allocation sections to the amendment.

House Amendment "A" to Committee Amendment "B" (H-736)

This amendment proposed to amend Committee Amendment "B" as follows:

1. Provide funds for sexual assault and domestic violence intervention and prevention.

2. Authorize the expenditure of funding among pharmaceutical benefits programs administered by the Department of Human Services.

3. Authorize certain balances to carry forward and make adjustments to appropriations to reflect the estimated balances that will be carried forward. It also proposed to recognize savings in the Department of Economic and Community Development and utilize some of the TANF reserve funds within the Department of Human Services.

House Amendment "B" to Committee Amendment "A" (H-731)

This amendment proposed to require the Department of Human Services to adopt rules increasing the amount of income that may be retained by residents of nursing and residential care facilities.

House Amendment "C" to Committee Amendment "A" (H-732)

This amendment proposed to require the Department of Human Services to adopt rules increasing the amount of income that may be retained by residents of nursing and residential care facilities. This amendment proposed to fund the increase by funds that would otherwise go to legislative cost-of-living salary adjustments.

House Amendment "D" to Committee Amendment "A" (H-733)

This amendment proposed to repeal the Maine Learning Technology Endowment and transfer the funds currently in the endowment to the unappropriated surplus of the General Fund.

House Amendment "E" to Committee Amendment "A" (H-734)

This amendment proposed to deappropriate funding for fingerprinting and background checks. The amendment proposed to appropriate funds for one additional adult probation officer to work with individuals convicted of sexual abuse. It also proposed to appropriate funds to be distributed as grants to local mentoring programs and to appropriate funds for 7 human services caseworkers to work with child abuse cases.

House Amendment "F" to Committee Amendment "A" (H-735)

This amendment proposed to amend Committee Amendment "A" to specify that the 7% sales tax on prepared foods is imposed only on food sold in establishments licensed under the Maine Revised Statutes, Title 22, chapter 562.

House Amendment "G" to Committee Amendment "A" (H-737)

This amendment proposed to deappropriate funding for the maintenance and network management associated with the ATM distance learning network.

House Amendment "H" to Committee Amendment "A" (H-738)

This amendment proposed to provide additional funds for General Purpose Aid for Local Schools based on a 5% increase, including cushion, over funding provided for fiscal year 2001-02. This amendment proposed funding this increase by transferring funds from the Maine Learning Technology Endowment.

House Amendment "I" to Committee Amendment "A" (H-740)

This amendment proposed to make a correction to the designation of a fund. It also proposed to strike that part of Committee Amendment "A" that amends the penalties for late filing of accelerated campaign reporting under the Maine Clean Election Act and that provides additional appropriations for increased costs of the Commission on Governmental Ethics and Election Practices and Other Special Revenue funds allocations for one additional General Counsel position.

House Amendment "J" to Committee Amendment "A" (H-741)

PART AAAAA proposed to provide a General Fund appropriation to the Department of Labor for the continuation of the Maine Airs program through the Iris Network, formerly known as the Maine Center for the Blind and Visually Impaired.

PART BBBBB proposed to authorize the Chief of the State Police to enter into reciprocity agreements with other states concerning permits to carry concealed firearms and to appropriate funds necessary to administer those agreements.

PART CCCCC proposed to direct the State Fire Marshal to negotiate a bulk purchase price for thermal imaging cameras to be purchased by local fire-fighting units and law enforcement agencies. This Part also proposed to establish a fund by which loans can be made for the purchase of thermal imaging cameras and provide an appropriation and an allocation for these purposes.

PART DDDDD proposed to increase the allowable forest management and harvest plan income tax credit for parcels of land greater than 10 acres from $200 to $300, beginning January 1, 2002.

PART EEEEE proposed to appropriate funds to conduct a low-flow study in Aroostook County.

PART FFFFF proposed to consolidate existing dam safety laws within the Department of Defense, Veterans and Emergency Management and moves the Dam Repair and Reconstruction Fund from the Department of Environmental Protection to the Department of Defense, Veterans and Emergency Management.

PART GGGGG proposed to exempt from the sales tax sales to incorporate nonprofit organizations that provide temporary child placement and adoption services and are licensed by the Department of Human Services as child-placing agencies or emergency shelters.

PART HHHHH proposed to provide funds for the maintenance of Maine's monuments at Gettysburg National Military Park.

PART IIIII proposed to provide additional funds from the Fund for a Healthy Maine for loans to Maine residents enrolled in a school of dental education or to repay loan agreements for practicing doctors of dental medicine who practice in underserved population areas.

PART JJJJJ proposed to authorize the issuance of transportation vouchers to persons with disabilities and appropriates funds for this purpose.

PART KKKKK proposed to appropriate one-time funds for the Oxford County Fair Society.

PART LLLLL proposed to require the Department of Human Services to amend the rules of reimbursement for durable medical equipment in 4 areas, including crossover claims for persons eligible under the Medicaid program and the Medicare program; removing the reimbursement cap on major purchases; granting approval for purchases requiring prior authorization if not granted within 30 days of submitting an application; and reimbursement for travel costs when necessary to make repairs and service durable medical equipment.

PART MMMMM proposed to authorize payments from the Maine Rainy Day Fund for death benefits for law enforcement officers, firefighters and emergency medical services personnel who die in the line of duty.

PART NNNNN proposed to provide funds to create a digital library to meet the educational, research, business and economic needs of Maine.

PART OOOOO proposed to exclude from the calculation of a consumer's income the income of a consumer's spouse under the home-based care program within the Bureau of Elder and Adult Services within the Department of Human Services.

House Amendment "K" to Committee Amendment "A" (H-742)

This amendment proposed to eliminate funding for all new positions established by Committee Amendment "A" and instead provide additional funds for general purpose aid for local schools.

House Amendment "L" to Committee Amendment "A" (H-747)

This amendment proposed to remove the emergency preamble and emergency clause from the bill as amended. The amendment adjusts dates in the cigarette tax and the meal tax provisions to reflect the nonemergency status. It proposed to authorize the State Controller to keep open the official system of general accounts of State Government for fiscal year 2000-01 to make post-closing entries and adjustments to carry out the provisions of this Act. The amendment also proposed to increase transfers from the Maine Rainy Day Fund to the unappropriated surplus of the General Fund.

This amendment also changes the date of transfer of funds to the Governor Baxter School for the Deaf Student Trust Fund from July 1, 2001 to October 1, 2001. The amendment also strikes the language authorizing a tax anticipation note to cover the debt service costs associated with that note. The amendment also proposed to change the reporting date on which the Maine State Housing Authority must report on the energy issues from September 1, 2001 to November 1, 2001. The amendment also proposed to strike the language that authorizes the expenditure of funding among pharmaceutical benefits programs administered by the Department of Human Services.

Senate Amendment "A" to Committee Amendment "A" (S-364)

This amendment proposed to amend the laws governing the general purpose aid to local schools program. Current law proposed to limit the state share of the foundation allocation for each administrative unit to the same proportion of the maximum allocation as the local administrative unit raises of its maximum local share of the foundation allocation. The amendment proposed to limit the reduction in the state share of the foundation allocation for each school administrative unit that raises its local share of the foundation allocation if the school administrative unit has raised 9.0 mills in fiscal year 2001-02 and 10.0 mills in fiscal year 2002-03.

Senate Amendment "B" to Committee Amendment "A" (S-365)

This amendment proposed to fund the per diem and other expenses associated with increasing the number of meetings and extending office hours of the Commission on Governmental Ethics and Election Practices from the Maine Clean Election Fund.

Senate Amendment "C" to Committee Amendment "A" (S-366)

This amendment proposed to begin the increase in state-municipal revenue sharing on November 1, 2002 and repeals the July 1, 2003 sunset.

Senate Amendment "D" to Committee Amendment "A" (S-367)

This amendment proposed to remove the July 1, 2003 sunset in the increase of state-municipal revenue sharing to 5.2% of sales and income tax receipts.

Senate Amendment "E" to Committee Amendment "A" (S-368)

This amendment proposed to establish a cold case homicide squad within the Department of Public Safety and terminates the squad on October 30, 2004 unless the squad is continued by the Legislature. The amendment proposed to require the Department of Public Safety to provide a report to the joint standing committee of the Legislature having jurisdiction over criminal justice matters by January 1, 2004 evaluating the success of the cold case homicide squad and making recommendations on continuation of the squad. The amendment proposed to include an appropriation to fund one state police detective position for the cold case homicide squad.
