§212. Abandonment or cessation of license

1.  Notification of abandonment or cessation required.  A licensee that voluntarily abandons the licensed premises or otherwise permanently ceases all activities relating to the operation of a cannabis establishment under its license shall notify the office and the municipality in which the licensed premises are located at least 48 hours in advance of the abandonment or cessation.

2.  Forfeiture and destruction of cannabis and cannabis products.  Prior to abandoning the licensed premises of the licensee or ceasing operations, a licensee shall provide the office and the municipality in which the licensed premises are located with a full accounting of all adult use cannabis and adult use cannabis products located within the licensed premises and forfeit the cannabis and cannabis products to the office for destruction in accordance with section 803.

For the purposes of this section, "municipality" means, in the case of a cannabis establishment not located in the unorganized and deorganized areas, the city, town or plantation in which the cannabis establishment is located; or, in the case of a cannabis establishment located in the unorganized and deorganized areas, the Maine Land Use Planning Commission and the town or plantation in which the cannabis establishment is located or, in the case of a cannabis establishment located in a township, the county commissioners of the county in which the township is located.   [PL 2017, c. 409, Pt.
