Sec. 1. 29-A MRSA §2115 is enacted to read:

§2115.__Use of hand-held telephone while operating motor vehicle

It is unlawful for a person operating a motor vehicle to use a telephone that requires the operator to hold the telephone in the operator's hand.

Violation of this section is a traffic infraction subject to the a forfeiture of not less than $100 for the first violation, $200 for the 2nd and $250 for the 3rd and each subsquent violation committed within one year.

SUMMARY

This bill prohibits a person from using a hand-held telephone while operating a motor vehicle if the operator holds the telephone in the operator's hand while driving. The bill makes the offense a traffic infraction.
