7.__Violation of rules.__Violate the rules adopted by the board or
any provisions of this chapter.

 
§14013.__Exemptions

 
This chapter does not apply to any electrician, plumber,
carpenter or any other person who repairs, maintains or inspects
real property or improvements to real property and who does not
represent to the public through personal solicitation or public
advertising that the person is in the business of home inspection.__
The provisions of this chapter may not be construed to prevent any
person from performing any acts that the person is authorized to
perform pursuant to a license or registration issued by this State
or any governmental subdivision of this State.

 
§14014. Grandfathering

 
1.__Requirements.__A person who applies for licensure and remits
the application and appropriate fees by January 1, 2001 must be
licensed by the board if:

 
A.__The applicant has previously passed the examination of the
American Society of Home Inspectors, or its successor
organization, or an equivalent examination approved by the
board; or

 
B.__The applicant submits satisfactory evidence of having used
or been identified by the title "home inspector" and has a
combination of home inspector education and diversified and
appropriate experience totaling 6 years; except that if the
home inspector has one year or less of home inspector
education, then 2 years of home inspector experience
acceptable to the board may be substituted for each year of
home inspector education required.__A person is considered to
have used or been identified by the title "home inspector" if
the person demonstrates to the satisfaction of the board that
the person was either self-employed as a home inspector or, in
the course of regular employment, rendered or offered to
render to another person home inspection services.

 
§14015.__Inactive licenses

 
The board, by rule, may adopt terms and conditions by which an
inspector may apply for, renew or place a license on inactive
status and rules by which an inactive inspector may return to
active status.__Rules adopted pursuant to this section are routine
technical rules as defined by Title 5, chapter 375, subchapter II-
A.
