business in this State if the licensee maintains an active place of | business in the state of domicile. |

| | The licensee shall report any change of address or name or other | material change in the conditions or qualifications set forth in | the original application no later than 10 days after the change.__ | Upon proper application and payment of the prescribed fee, the | board records must be changed and a new license issued for the | unexpired term of the current license, if appropriate. |

| §14011.__Waiver for out-of-state applicants |
|
| | The board may waive any license requirement for an applicant | with a valid license from another state having license requirements | substantially equivalent to those of this State. |
|
| | A professional inspector, a home inspector or an apprentice | inspector licensed under this chapter may not: |
|
| | 1.__Contingent assignment.__Accept an assignment for home | inspection if the employment or fee is contingent on the reporting | of a specific, predetermined condition of the improvements to real | property or is contingent on the reporting of specific findings | other than those known by the inspector to be facts at the time of | accepting the assignment; |
|
| | 2.__Dishonesty, fraud or misrepresentation.__Act in a manner or | engage in a practice that is dishonest or fraudulent or that | involves deceit or misrepresentation; |
|
| | 3.__Negligence; incompetence.__Perform a home inspection in a | negligent or incompetent manner; |
|
| | 4.__Undisclosed principal.__Act in the dual capacity of | inspector and undisclosed principal in a transaction; |
|
| | 5.__Real estate broker or salesperson.__Act in the dual capacity | of inspector and real estate broker or salesperson in a | transaction; |
|
| | 6.__Perform repairs or maintenance.__Perform or agree to perform | any repairs or maintenance in connection with a home inspection | pursuant to the provisions of any earnest money contract, lease | agreement or exchange of home; or |
