| 12.__Licensee.__"Licensee" means a person holding an apprentice | inspector license, a home inspector license or a professional | inspector license issued under this chapter. |

| | 13.__Professional inspector.__"Professional inspector" means a | person who is a licensee and who represents to the public that the | person is trained and qualified to perform a home inspection and | who accepts employment for the purpose of performing a home | inspection for a buyer or seller of real property. |

| §14002.__License required |
|
| | Except as provided by section 14013, a person may not conduct, | for a fee or other valuable considerations, a home inspection | relating to real property located in this State without first | obtaining a professional inspector, home inspector or apprentice | inspector license as provided by this chapter. |

| §14003.__Maine Board of Home Inspectors; establishment |
|
| | 1.__Establishment.__The Maine Board of Home Inspectors as | established by Title 5, section 12004-A, subsection 9-C is | established within the Department of Professional and Financial | Regulation and shall carry out the purposes of this chapter. |

| | 2.__Members.__The board is composed of 7 members appointed by | the Governor.__Each member must be a resident of this State.__The | board consists of: |

| A.__One professional inspector actively engaged in the | practice of home inspecting at the time of appointment and | must have been primarily engaged in the practice of home | inspecting for at least 5 years before the member's | appointment; |
|
| B.__One representative of a mortgage lending organization; |
|
| C.__One residential or real estate appraiser; and |
|
| D.__Four public members, 3 of whom are familiar with home | inspection. |
|
| No more than 2 members of the board may hold a real estate broker | license. |

| | 3.__Appointments.__The Governor shall make initial appointments | within 60 days of the effective date of this chapter.__The | professional inspector initially appointed must be licensed in | accordance with this chapter on or before July 1, |
