Sec. 1. 37-B MRSA c. 3, sub-c. VII-A is enacted to read:

SUBCHAPTER VII-A

SELECTIVE SERVICE REGISTRATION AWARENESS

AND COMPLIANCE

§351.__Definitions

For the purposes of this subchapter, "employee" does not include elective officers and officers who, under the Constitution of Maine, are appointed by the Governor or chosen by the Legislature.

§352.__Application

A person who is not in compliance with the Military Selective Service Act, 50 United States Code, Section 451, et seq. may not:

1.__Postsecondary education.__Enroll in a state-supported institution of postsecondary or higher education;

2.__Student loans.__Receive a loan, grant, scholarship or other financial assistance for postsecondary or higher education supported by state revenue, including federal funds, gifts or grants accepted by the State or receive a student loan guaranteed by the State; or

3.__Government employee.__Having attained 18 years of age, be employed as a state employee or an employee of a political subdivision of the State.

§353.__Responsibility for compliance

An official having charge of or authority over the hiring of employees of the State or a political subdivision of the State, a state-supported institution of postsecondary or higher education or having authority to make decisions relating to the granting of state-supported financial assistance for postsecondary or higher education, as described in section 352, subsection 2, shall ensure that applicants are in compliance with the requirements of section 352 or covered by the exceptions of section 354.
