| BOARD OF CEMETERY AND CREMATORY SERVICES |
|
| §1391.__Board of Cemetery and Crematory Services |
|
| | 1.__Board.__There is established the Board of Cemetery and | Crematory Services, as established by Title 5, section 12004-A, | subsection 47, referred to in this section as the "board." |
|
| | 2.__Membership.__The board is composed of 5 members.__The | Attorney General is an ex officio member, and the 4 other members | must be appointed by the Governor from a list of nominees | submitted to the Governor from a statewide cemetery association.__ | Board members must have at least 5 years experience in the | administration or operation of a cemetery or crematory. |

| | 3.__Term; meeting; quorum.__Each member of the board serves a | term of 3 years.__The board shall meet at least 4 times a year.__ | Three members of the board constitute a quorum. |
|
| | 4.__Duties and responsibilities.__The board shall: |
|
| A.__Work closely with the Department of Human Services, | Bureau of Health and Office of Data Research and Vital | Statistics on issues that relate__to cemetery and crematory | operations; |
|
| B.__Assist the Attorney General in the investigation of and | to hold hearings on consumer complaints concerning | cemeteries and crematories; and |
|
| C.__Adopt rules for the burial industry regulating the | activities of burial and related cemetery and crematory | operations.__For purposes of this subsection, "burial" has | the same meaning as in Title 32, section 1400, subsection 2. |

| | 5.__Compensation; expenses.__Members of the board serve | without compensation.__A member's travel expenses are | reimbursable. |
