Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 20-A MRSA §6302, as enacted by PL 1991, c. 181, §2, is
amended to read:

 
§6302. Air quality in school buildings

 
1. Applicability. This section applies to school buildings
subject to basic school approval under section 4502 in which the
heating, ventilation and air-conditioning system is mechanically
driven.

 
2. Operation. Each school administrative unit shall ensure
that the maintain heating, ventilation and air-conditioning
system is systems that are:

 
A. Maintained and operated to provide at least the quantity
of outdoor quality of indoor air required by the state
building standards code in effect at the time the building
permit was issued or the heating, ventilation and air-
conditioning system was installed, whichever is later
current standards of the Occupational Safety Health
Administration, the National Institute of Occupational
Safety and Health and the American Society of Heating,
Refrigerating and Air-conditioning Engineers or any of their
successor organizations for air flow, air quality, air
composition and air exchange rate; and

 
B. Operated continuously during school activity hours
except:

 
(1) During scheduled maintenance and emergency
repairs; and

 
(2) During periods for which school officials can
demonstrate to the commissioner's satisfaction that the
quantity of outdoor air supplied by an air supply
system that is not mechanically driven and by
infiltration meets the outdoor air supply rate air
quality standards required by paragraph A.

 
3. Inspection and record. Each school administrative unit is
responsible for:

 
A. Inspection of Monitoring or contracting with a qualified
professional to monitor the heating, ventilation and air-
conditioning system systems in its schools and filing with the
Department of Human Services, Bureau of Health by the first of
each month a report on the quality of air in the school.__The
report must be on a form that is developed by the Bureau of
Health and the Department of Administrative and Financial
Services, Bureau of General Services, Division of Safety and
Environmental Services and that includes each
