Sec. 1. 20-A MRSA §15905-A, sub-§3, as enacted by PL 1991, c. 655, §10, is amended to read:

3. Local vote. Prior In a school administrative district, community school district or a municipality that is not governed by municipal charter, prior to approval by the commissioner, each nonstate funded project must receive a favorable vote in accordance with section 15904, except that section 15904, subsection 4 does not apply. In a municipality that is governed by a municipal charter, a nonstate funded project must be authorized in accordance with the procedures required by the municipal charter and section 15904 does not apply.

SUMMARY

This bill provides that in municipalities governed by municipal charters, locally funded school construction projects must be approved in accordance with the procedures required by the applicable municipal charter rather than the referendum procedures set forth in the Maine Revised Statutes, Title 20-A, section 15904.
