| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 22 MRSA §2152, sub-§5-B is enacted to read: |

| | | 5-B.__Irradiated food.__"Irradiated food" means: |
|
| | | A.__Any food that has been treated with gamma radiation or | | other ionizing radiation; or |
|
| | | B.__Any food that contains any ingredient that has been | | treated with gamma radiation or other ionizing radiation. |
|
| | | "Irradiated food" includes a spice that has been treated with | | gamma radiation or other ionizing radiation and is sold as spice, | | but another food that contains as an ingredient a spice that has | | been so treated may not be considered irradiated food solely | | because of the presence of that spice. |

| | | Sec. 2. 22 MRSA §2155, sub-§11 is enacted to read: |

| | | 11.__Irradiated food.__The retail sale of any irradiated food | | for human or animal consumption that the retail seller knows is | | irradiated food unless the food is labeled "irradiated food." |
|
| | | This bill prohibits the knowing retail sale of irradiated food | | unless the food is labeled "irradiated food." |
