A person who violates a provision of this Act for which no other
criminal penalty is provided by this chapter, upon conviction is
subject to imprisonment for not more than one year or a fine of not
more than $1,000, or both.__If a violation involves intent to
defraud or any distribution or attempted distribution of an article
that is adulterated, except as defined in section 2511-A,
subsection 1, paragraph H, the person is subject to a fine of not
more than $10,000 or imprisonment for not more than 3 years, or
both.__A person is not subject to penalties under this section for
receiving for transportation an article or animal in violation of
this chapter if the receipt was made in good faith, unless that
person refuses to furnish on the request of a representative of the
commissioner the name and address of the person from whom that
person received the article or animal and copies of all documents
pertaining to the delivery of the article or animal to that person.

 
This chapter may not be construed as requiring the
commissioner to report minor violations of this chapter for
prosecution or for the institution of libel or injunction
proceedings if the commissioner believes that the public interest
is adequately served by a suitable written notice of warning.

 
§2527.__Powers of commissioner

 
1.__Powers.__The commissioner has the authority:

 
A.__To investigate from time to time and to gather and
compile information concerning the organization, business,
conduct, practices, management and relationship to other
persons of a person engaged in intrastate commerce; and

 
B.__By general or special orders, to require a person
engaged in intrastate commerce to file with the
commissioner, in a form prescribed by the commissioner,
annual or special reports or answers in writing to specific
questions, furnishing to the commissioner information the
commissioner requires as to the organization, business,
conduct, practices, management and relationship to other
persons of the person filing the reports or answers in
writing.__The reports and answers must be made under oath as
the commissioner prescribes and must be filed with the
commissioner within a period the commissioner prescribes,
unless additional time is granted by the commissioner.

 
2.__Witnesses and evidence.__For the purposes of this chapter,
at all reasonable times the commissioner must have access to and
the right to copy any documentary evidence of a person being
investigated or proceeded against and may, in a
