manner consistent with the Maine Administrative Procedure Act,
require by subpoena the attendance and testimony of witnesses and
the production of all documentary evidence of any person relating
to a matter under investigation.__The commissioner may sign
subpoenas and may administer oaths and affirmations, examine
witnesses and receive evidence.

 
A.__The commissioner may order testimony to be taken by
deposition in any proceeding or investigation pending under
this chapter at any stage of such a proceeding or
investigation.__Depositions may be taken before any designee
of the commissioner who has the power to administer oaths.__
Testimony must be reduced to writing by the person taking
the deposition or under that person's direction and must
then be subscribed by the deponent.__A person may be
compelled to appear and depose and to produce documentary
evidence in the same manner as witnesses may be compelled to
appear and testify and produce documentary evidence before
the commissioner.

 
B.__A person may not be excused from attending and
testifying or from producing books, papers, schedules of
charges, contracts, agreements or other documentary evidence
before the commissioner or in response to the subpoena of
the commissioner, whether the subpoena is signed or issued
by the commissioner or by the commissioner's designee.__A
person may not be excused from attending or testifying in a
cause or proceeding based on an alleged violation of this
chapter on the ground that the testimony, documentary
evidence or other evidence required of that person might
incriminate that person or subject that person to a penalty
or forfeiture.__After claiming a privilege against self-
incrimination, a person may not be prosecuted or subjected
to a penalty or forfeiture for any transaction or matter
concerning the information the person is required to testify
to or produce.__A person who commits perjury is not exempt
from prosecution or punishment.

 
3.__Failure to comply; false statements.__A person is guilty__
of a crime punishable by a fine of not less than $1,000 or more
than $5,000 or by imprisonment for a term of not more than 3
years, or both, if that person willfully:

 
A.__Makes or causes to be made a false entry or statement of
fact in a report required under this chapter;

 
B.__Makes or causes to be made a false entry in an account,
record or memorandum kept by a person subject to this
chapter;
