| 2.__Fee for fireworks technician assistant.__The fee for a | fireworks technician assistant license is $15. |

| §234.__Renewal of license |
|
| | Each fireworks technician license and fireworks technician | assistant license is valid for a term of one year.__Unless | revoked or suspended, the license is renewable annually. |

| §235.__Denial; suspension; revocation; grounds |
|
| | The commissioner may, after a hearing in conformance with | applicable provisions of the Maine Administrative Procedure Act, | suspend or revoke a license issued under this chapter.__The | following are grounds for denial, suspension or revocation of a | license: |
|
| | 1.__Fraud or deceit.__The practice of fraud or deceit in | obtaining a license under this chapter or in the performance of | services within the scope of the license issued; |
|
| | 2.__Conviction of certain crimes.__Conviction of a crime that | relates directly to the practice for which the person is licensed | or conviction of any crime for which incarceration for one year | or more may be imposed; |
|
| | 3.__Violation of chapter or rule.__Any violation of this | chapter or any rule adopted by the commissioner; |
|
| | 4.__Aiding or abetting unlicensed practice.__Aiding or | abetting the practice of displaying or discharging fireworks by a | person not duly licensed under this chapter and who is | represented as duly licensed; or |
|
| | 5.__Incompetence.__Incompetence in the practice of displaying | or discharging fireworks.__A licensee is considered incompetent | in the practice if the licensee has: |
|
| A.__Engaged in professional conduct that evidences a lack of | ability or fitness to perform the duties for which that | licensee is licensed; or |
|
| B.__Engaged in professional conduct that evidences a lack of | knowledge of, or inability to apply, appropriate principles | or skills to carry out the practice for which that licensee | is licensed. |
