§234.__Renewal of license

Each fireworks technician license and fireworks technician assistant license is valid for a term of one year.__Unless revoked or suspended, the license is renewable annually.

§235.__Denial; suspension; revocation; grounds

The commissioner may, after a hearing in conformance with applicable provisions of the Maine Administrative Procedure Act, suspend or revoke a license issued under this chapter.__The following are grounds for denial, suspension or revocation of a license:

1.__Fraud or deceit.__The practice of fraud or deceit in obtaining a license under this chapter or in the performance of services within the scope of the license issued;

2.__Conviction of certain crimes.__Conviction of a crime that relates directly to the practice for which the person is licensed or conviction of any crime for which incarceration for one year or more may be imposed;

3.__Violation of chapter or rule.__Any violation of this chapter or any rule adopted by the commissioner;

4.__Aiding or abetting unlicensed practice.__Aiding or abetting the practice of displaying or discharging fireworks by a person not duly licensed under this chapter and who is represented as duly licensed; or

5.__Incompetence.__Incompetence in the practice of displaying or discharging fireworks.__A licensee is considered incompetent in the practice if the licensee has:

A.__Engaged in professional conduct that evidences a lack of ability or fitness to perform the duties for which that licensee is licensed; or

B.__Engaged in professional conduct that evidences a lack of knowledge of, or inability to apply, appropriate principles or skills to carry out the practice for which that licensee is licensed.
