| This bill proposes to require a solid waste facility that has |
| a capacity in excess of the waste stream generated by the |
| municipality in which the facility is located to prove to the |
| Commissioner of Environmental Protection that the facility meets |
| the substantial public benefit test required of new or expanded |
| solid waste facilities. |
