Sec. 1. 5 MRSA §1782, sub-§3, as enacted by PL 1985, c. 758, §1, is amended to read:

3. Director. "Director" means the Director of the Bureau of Public Improvements General Services.

Sec. 2. 5 MRSA §1783, sub-§3, ¶B is enacted to read:

B.__Notwithstanding this subsection, if 50% or less of an available facility is unused and therefore available for lease or if a total of 2,500 square feet or less is unused and therefore available for lease, competitive bids are not required and the director may lease that portion of the available facility to the type of organization described in paragraph A.

SUMMARY

This bill allows the Director of the Bureau of General Services within the Department of Administrative and Financial Services to lease a state-owned facility without soliciting competitive bids if 50% or less or 2,500 feet or less of the facility is unused. The current restriction that the lessee be compatible with the agency in the facility would continue to apply.

This bill also corrects the name of the Bureau of General Services.
