| Be it enacted by the People of the State of Maine as follows: |

| | Sec. 1. 30-A MRSA §4301, sub-§§10-A and 14-B are enacted to read: |

| | 10-A.__Mobility arterial.__"Mobility arterial" means an | arterial highway, as defined in Title 23, section 704, subsection | 1, paragraph A, that has a posted speed limit of 40 miles per | hour or more; is located between urban compact areas, as defined | in Title 23, section 754, subsection 2, or service center | communities; and carries an average annual daily traffic of at | least 5,000 vehicles per day for at least 50% of its length. |

| | 14-B.__Retrograde arterial.__"Retrograde arterial" means a | mobility arterial where the access-related crash-per-mile rate | exceeds the 1999 statewide average for arterial highways with the | same posted speed limit. |

| | Sec. 2. 30-A MRSA §4404, sub-§5, as enacted by PL 1989, c. 104, Pt. A, | §45 and Pt. C, §10, is amended to read: |
|
| | 5. Traffic. The proposed subdivision will not cause | unreasonable highway or public road congestion or unsafe | conditions with respect to the use of the highways or public | roads existing or proposed and, if the proposal includes access | to a mobility arterial or retrograde arterial, the proposed | subdivision will not cause a reduction in the posted speed of | that mobility arterial or retrograde arterial; |

| | This bill is the recommendation of the Joint Standing | Committee to Study Growth Management. It amends the subdivision | review criteria for traffic by requiring a determination that the | proposed subdivision will not reduce the posted speed of a | mobility arterial or retrograde arterial. |
