Sec. 1. 22 MRSA §1599-B is enacted to read:

§1599-B.__Abortion provider responsibility

1.__Costs of mental health care.__Except as provided in subsection 2, a physician who performs an abortion on a minor is liable for the future mental health care costs of the minor if she suffers from posttraumatic stress disorder related to the abortion.

2.__Abortion performed on minor without parental consent; court order.__A physician who performs an abortion on a minor is responsible for the costs listed in subsection 1 unless consent to the abortion was given:

A.__By the minor's parent pursuant to section 1597-A, subsection 2, paragraph A; or

B.__By court order pursuant to section 1597-A, subsection 6.

SUMMARY

This bill provides that a physician who performs an abortion on a minor is responsible for mental health costs related to the abortion if the abortion was performed without parental consent or without a court order providing consent.
