It is unlawful and a violation of this chapter for any person to:

1.__Error or fraud.__Obtain a certification or apprentice permit through error or fraud;

2.__False presentation.__Present or attempt to use the certification or apprentice permit of another person for any reason;

3.__Impersonation.__Impersonate another person who holds a certification or an apprentice permit or use an expired or revoked certification;

4.__Not registered as apprentice.__Use an apprentice permit when the holder is not enrolled in a registered apprenticeship program;

5.__False or forged evidence.__Give false or forged evidence of any kind to the board in an application for the issuance or renewal of a certification or apprentice permit under this chapter;

6.__Code violation.__Willfully or negligently violate the State Medical Gas and Vacuum System Code or the rules of the board adopted pursuant to this chapter;

7.__Misrepresentation.__Knowingly make a substantial misrepresentation of services provided; or

8.__False representation of status.__Knowingly make any false promise regarding a person's certification or apprentice permit status with intent to influence, persuade or induce an individual to contract for services regulated or controlled under this chapter.

§15370.__Violations through employment of another person

or conspiracy

It is a violation of this chapter to employ another person or to otherwise conspire with another person to violate any terms of this chapter or any rule adopted pursuant to this chapter.
