| | Sec. 2. Commission membership. Resolved: That the commission consists | of members appointed as follows: |

| | 1. Two members of the Senate, appointed by the President of | the Senate; |
|
| | 2. Two members of the House of Representatives, appointed | by the Speaker of the House; and |
|
| | 3. The Director of the State Planning Office, or the | director's designee; the chair of the Public Utilities | Commission, or the chair's designee; the Public Advocate, or | the Public Advocate's designee; the Commissioner of | Transportation, or the commissioner's designee; the | Commissioner of Conservation, or the commissioner's designee; | and the Commissioner of Environmental Protection, or the | commissioner's designee. |

| | At least one of the 4 legislative members must be a member | of the political party holding the 2nd largest number of seats | in the Legislature; and be it further |

| | Sec. 3. Chairs. Resolved: That the first-named Senate member is | the Senate chair and the first-named House of Representatives | member is the House chair; and be it further |

| | Sec. 4. Appointments; convening of commission. Resolved: That all | appointments must be made no later than 30 days following the | effective date of this resolve. The appointing authorities | shall notify the Executive Director of the Legislative Council | once all appointments have been completed. Within 15 days | after appointment of all members, the chair shall call and | convene the first meeting of the commission; and be it further |

| | Sec. 5. Duties. Resolved: That the commission, with assistance | from the Energy Resources Council, shall develop a | comprehensive energy plan for the State. The plan must | include: |

| | 1. An assessment of the future demand for energy in the | State under a variety of scenarios regarding energy prices and | anticipated conservation and cogeneration measures; |
|
| | 2. A study of the various options available to the State to | meet growing needs for energy and energy transmission, | including, but not limited to, least-cost energy planning, | conservation, energy efficiency, cogeneration, small power | production, |
