Sec. 2. Commission membership. Resolved: That the commission consists of members appointed as follows:

1. Two members of the Senate, appointed by the President of the Senate;

2. Two members of the House of Representatives, appointed by the Speaker of the House; and

3. The Director of the State Planning Office, or the director's designee; the chair of the Public Utilities Commission, or the chair's designee; the Public Advocate, or the Public Advocate's designee; the Commissioner of Transportation, or the commissioner's designee; the Commissioner of Conservation, or the commissioner's designee; and the Commissioner of Environmental Protection, or the commissioner's designee.

At least one of the 4 legislative members must be a member of the political party holding the 2nd largest number of seats in the Legislature; and be it further

Sec. 3. Chairs. Resolved: That the first-named Senate member is the Senate chair and the first-named House of Representatives member is the House chair; and be it further

Sec. 4. Appointments; convening of commission. Resolved: That all appointments must be made no later than 30 days following the effective date of this resolve. The appointing authorities shall notify the Executive Director of the Legislative Council once all appointments have been completed. Within 15 days after appointment of all members, the chair shall call and convene the first meeting of the commission; and be it further

Sec. 5. Duties. Resolved: That the commission, with assistance from the Energy Resources Council, shall develop a comprehensive energy plan for the State. The plan must include:

1. An assessment of the future demand for energy in the State under a variety of scenarios regarding energy prices and anticipated conservation and cogeneration measures;

2. A study of the various options available to the State to meet growing needs for energy and energy transmission, including, but not limited to, least-cost energy planning, conservation, energy efficiency, cogeneration, small power production,
