other provision of law, payments must be made to those employees of | the State who were not authorized to receive merit increases in | fiscal year 2003-04 as a result of the provisions of Public Law | 2003, chapter 20, Part D, section 22 as provided by agreement | between the State and bargaining agents representing state | employees. Confidential employees, defined as executive branch | employees in positions excluded from bargaining pursuant to the | Maine Revised Statutes, Title 26, section 979-A, subsection 6, | paragraphs B, C, D, I and J, must receive similar and equitable | treatment. The General Fund and Other Special Revenue Funds share | of the payments must be made from the General Fund Salary Plan | account, and the Highway Fund share of the payments must be made | from the Highway Fund Salary Plan account. All other payments must | be made from the appropriate account for each affected employee. | This sum may not be considered earnable compensation under the | Maine State Retirement System. |

| | Sec. C-10. Payment for merit increases; institutional services employees. | Notwithstanding Public Law 2003, chapter 20, Part D, section 22, | or any other provision of law, those institutional services | employees who would have been eligible to receive a step increase | from Step 6 to Step 7 during the period July 1, 2003 to June 30, | 2004 as a merit increase bargained for as a result of a market | pay study must be paid those merit increases if provided for in | an agreement between the State and the bargaining agent for the | institutional services employees. The General Fund share of the | payments must be made from the General Fund Salary Plan account. | All other payments must be made from the appropriate account for | each affected employee. |

| | Sec. C-11. Calculation and transfer; health insurance cost savings. | Notwithstanding any other provision of law, the State Budget | Officer shall calculate the amount of savings in Part A, section | 1 that applies against each General Fund account for all | departments and agencies from savings in the cost of health | insurance and shall transfer the amounts by financial order upon | the approval of the Governor. These transfers are considered | adjustments to appropriations in fiscal year 2004-05. The State | Budget Officer shall provide the joint standing committee of the | Legislature having jurisdiction over appropriations and financial | affairs a report of the transferred amounts no later than January | 15, 2005. |

| | Sec. C-12. Alcoholic beverages; allotment of funds. Notwithstanding any | other provision of law, the allotment of funds in the Bureau of | Alcoholic Beverages and the Alcoholic Beverage Freight accounts | in the Department of Administrative and Financial Services may be | increased by financial order during fiscal year 2004-05 upon the | request of the State Budget Officer and approval of the Governor. |
