Sec. 38. 12 MRSA §10201, sub-§3, ķA, as enacted by PL 2003, c. 414, Pt.
A, §2 and affected by Pt. D, §7, is amended to read:

 
A. The commissioner may create dedicated accounts to
deposit money received from the sale of general merchandise
pursuant to this subsection and may accept money, goods and
services donated to the department to support specific
programs carried out by the department. Any money donated
to the department in support of a specific program must be
deposited into a dedicated account for the purpose of
funding activities carried out by that program.

 
Sec. 39. 12 MRSA §10201, sub-§5, ķA, as enacted by PL 2003, c. 414, Pt.
A, §2 and affected by Pt. D, §7, is amended to read:

 
A. The commissioner may provide for the reproduction, sale,
licensing, distribution and other disposal of any art
created in conjunction with the permit and.__The
commissioner shall establish by rule the procedures
governing the design of the permit and the reproduction,
sale, licensing, distribution and other disposal of any art
created in conjunction with the permit. Rules adopted
pursuant to this paragraph are routine technical rules as
defined in Title 5, chapter 375, subchapter 2-A.

 
Sec. 40. 12 MRSA §10201, sub-§6 is enacted to read:

 
6.__ Donations.__ The commissioner may accept money, goods and
services donated to the department to support specific programs
carried out by the department.__Any money donated to the
department in support of a specific program must be deposited
into a dedicated account for the purpose of funding activities
carried out by that program.

 
Sec. 41. 12 MRSA §10202, sub-§2, as enacted by PL 2003, c. 414, Pt. A,
§2 and affected by Pt. D, §7, is amended to read:

 
2. Additional funding. The appropriation of certain
additional funds are is governed by the following.

 
A. Appropriations to the Department-wide Inland Fisheries
and Wildlife program in the department for costs that are
associated with search and rescue may are not be considered
amounts appropriated to the department under the
Constitution of Maine, Article IX, Section 22. The
liability of the General Fund for search and rescue costs is
limited to the amount appropriated.
