| B. A person may not operate or attempt to operate a | watercraft: |
|
| (1) While under the influence of intoxicating liquor or | drugs or a combination of liquor and drugs; |
|
| (2) If 21 years of age or older, while having 0.08% or | more by weight of alcohol in that person's blood; or |
|
| (3)__If less than 21 years of age, while having any | amount of alcohol in the blood. |
|
| C. A person may not operate or attempt to operate a | snowmobile: |
|
| (1) While under the influence of intoxicating liquor or | drugs or a combination of liquor and drugs; |
|
| (2) If 21 years of age or older, while having 0.08% or | more by weight of alcohol in that person's blood; or |
|
| (3)__If less than 21 years of age, while having any | amount of alcohol in the blood. |
|
| D.__A person may not operate or attempt to operate an ATV: |
|
| (1)__While under the influence of intoxicating liquor | or drugs or a combination of liquor and drugs; |
|
| (2)__If 21 years of age or older, while having 0.08% or | more by weight of alcohol in that person's blood; or |
|
| (3)__If less than 21 years of age, while having any | amount of alcohol in the blood. |

| | Sec. 77. 12 MRSA §10701, sub-§§2 and 3, as enacted by PL 2003, c. 414, | Pt. A, §2 and affected by Pt. D, §7, are amended to read: |
