Sec. 74. 12 MRSA §10656, as enacted by PL 2003, c. 414, Pt. A, §2 and affected by Pt. D, §7, is repealed and the following enacted in its place:

§10656. Defacement of notices

1.__Prohibition on defacement of notices.__A person may not intentionally or knowingly mutilate, deface or destroy a notice or rule of the commissioner posted in conformity with this Part.

2.__Penalties.__The following penalties apply to violations of this section.

A.__A person who violates this section commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

B.__A person who violates this section after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.

Sec. 75. 12 MRSA §10701, sub-§1, as enacted by PL 2003, c. 414, Pt. A, §2 and affected by Pt. D, §7, is repealed.

Sec. 76. 12 MRSA §10701, sub-§1-A is enacted to read:

1-A.__Prohibition.__Prohibitions against hunting and operating under the influence are as follows.

A.__A person may not hunt wild animals or wild birds:

(1)__While under the influence of intoxicating liquor or drugs or a combination of liquor and drugs;

(2)__If 21 years of age or older, while having 0.08% or more by weight of alcohol in that person's blood; or

(3)__If less than 21 years of age, while having any amount of alcohol in that person's blood.
