Sec. 179. 12 MRSA §11601, sub-§4 is enacted to read:

 
4.__Unlawful possession.__A person may not possess a moose
that has been hunted in violation of this section.

 
Sec. 180. 12 MRSA §§11603 and 11604, as enacted by PL 2003, c. 414,
Pt. A, §2 and affected by Pt. D, §7, are repealed and the
following enacted in their place:

 
§11603.__Unlawful firearms for hunting moose

 
1. Prohibition.__A person may not use a .22 caliber rimfire
firearm or a shotgun using shot loads to hunt moose.

 
2. Penalties.__The following penalties apply to violations of
subsection 1.

 
A.__A person who violates subsection 1 commits a civil
violation for which a fine of not less than $100 nor more
than $500 may be adjudged.

 
B.__A person who violates subsection 1 after having been
adjudicated as having committed 3 or more civil violations
under this Part within the previous 5-year period commits a
Class E crime.

 
§11604.__Unlawful hunting methods

 
1. Prohibition.__A person may not use electronic calling
devices while hunting moose.

 
2. Penalties.__The following penalties apply to violations of
subsection 1.

 
A.__A person who violates subsection 1 commits a civil
violation for which a fine of not less than $100 nor more
than $500 may be adjudged.

 
B.__A person who violates subsection 1 after having been
adjudicated as having committed 3 or more civil violations
under this Part within the previous 5-year period commits a
Class E crime.

 
Sec. 181. 12 MRSA §11651, as enacted by PL 2003, c. 414, Pt. A, §2
and affected by Pt. D, §7, is repealed.
