| | Sec. 182. 12 MRSA §§11652, 11653 and 11654, as enacted by PL 2003, c. | 414, Pt. A, §2 and affected by Pt. D, §7, are repealed and the | following enacted in their place: |

| | 1. One moose per permit holder.__A person may not exceed the | bag limit of one moose per permit holder. In the case of a | permittee and a subpermittee, the permit allows one of them to | take one moose.__Except as provided in sections 12401 and 12402, | a person may not shoot more than one moose in a calendar year.__A | person may keep more than one legally obtained moose in that | person's home at any time. |

| | 2. Possession.__A person may not possess a moose in violation | of this section. |
|
| | 3. Penalty.__A person who violates this section commits a | Class D crime for which the court shall impose a sentencing | alternative of not less than 3 days for the first offense, none | of which may be suspended, and of not less than 10 days for each | succeeding offense, none of which may be suspended; the court | also shall impose a fine of not less than $1,000, none of which | may be suspended. |

| | 1.__Tags.__The commissioner shall prescribe the form and | content of and produce moose tags. |
|
| | 2. Tagging.__Prior to presenting a moose for registration, a | person may not possess or leave in the field or forest a moose | killed by that person unless the moose has securely attached to | it a plainly visible tag that conforms to the requirements | established under this section. |
|
| | 3. Penalties.__The following penalties apply to violations of | subsection 2. |
|
| A. A person who violates subsection 2__commits a civil | violation for which a fine of not less than $100 nor more | than $500 may be adjudged. |
|
| B.__A person who violates subsection 2 after having been | adjudicated as having committed 3 or more civil violations | under this Part within the previous 5-year period commits a | Class E crime. |
