as provided in sections 12301 and 12304, unless that animal is
possessed in accordance with chapter 921:

 
A.__Bear;

 
B.__Deer;

 
C.__Moose; or

 
D.__Wild turkey.

 
2.__Penalties.__A person who possesses a:

 
A.__Moose in violation of this section commits a Class D
crime for which the court shall impose a sentencing
alternative of not less than 3 days for the first offense,
none of which may be suspended, and of not less than 10 days
for each succeeding offense, none of which may be suspended;
the court also shall impose a fine of not less than $1,000,
none of which may be suspended;

 
B.__Wild turkey in violation of this section commits a Class
E crime for which the court shall impose a fine of not less
than $500, none of which may be suspended; or

 
C.__Bear or deer in violation of this section commits a
Class E crime.

 
SUBCHAPTER 2

 
TRANSPORTATION

 
§12351. Transportation by residents

 
A resident may transport home any wild animal or wild bird
that that resident has killed and that is legally possessed, as
long as that resident is properly licensed and has met all other
requirements of this Part.__A resident may have any lawfully
harvested wild animal or wild bird transported to a location
other than that person's home without accompanying the wild
animal or wild bird by obtaining a transportation permit from any
game warden.__There is no fee for a permit issued under this
section.

 
§12352. Transportation by nonresidents

 
A nonresident may transport to that person's home any lawfully
harvested wild animal or wild bird.__A nonresident may
