1.__Tags.__The commissioner shall prescribe the form and content of and produce wild turkey tags.

2. Tagging.__Prior to presenting a wild turkey for registration, a person may not possess or leave in the field or forest a wild turkey killed by that person unless the wild turkey has securely attached to it a plainly visible tag that conforms to the requirements established under this section.

3. Penalties.__The following penalties apply to violations of this section.

A. A person who violates subsection 2 commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

B.__A person who violates subsection 2 after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.

Sec. B-182. 12 MRSA §11753 is enacted to read:

§11753. Gift wild turkey

A person may not possess any part or parts of a wild turkey given to that person unless that gift wild turkey is labeled with the name of the person who registered it and the year the wild turkey was registered by that person.

A person who violates this section commits a Class E crime.

Sec. B-183. 12 MRSA §11801, sub-§1, as enacted by PL 2003, c. 414, Pt. A, §2 and affected by Pt. D, §7, is amended to read:

1. Unlawful hunting of wild turkey. A person may not hunt wild turkeys, except in accordance with section 11155, subsections 1 to 6; sections in violation of rules adopted under section 11701, 11702 and 12301; section 12304, subsection 3; and section 12305.

Sec. B-184. 12 MRSA §11851, sub-§3 is enacted to read:

3.__Penalty.__A person who violates this section commits a Class E crime.
