| | | A.__A person who violates subsection 1 commits a civil | | violation for which a fine of not less than $100 nor more | | than $500 may be adjudged. |

| | | B.__A person who violates subsection 1 after having been | | adjudicated as having committed 3 or more civil violations | | under this Part within the previous 5-year period commits a | | Class E crime. |

| | | §11855.__Unlawful use of migratory game birds |
|
| | | 1. Prohibition.__Unless specifically permitted by regulations | | of the federal Migratory Bird Treaty Act, 16 United States Code, | | Sections 703 to 712, or by rules adopted by the commissioner in | | conformity with Title 5, Part 18, except section 8052, subsection | | 3 of that Title, a person may not: |

| | | A.__Hunt migratory game birds; |
|
| | | B.__Possess migratory game birds; |
|
| | | C.__Transport migratory game birds; or |
|
| | | D.__Buy or sell migratory game birds. |

| | | 2. Penalty.__A person who violates subsection 1 commits a | | Class E crime. |
