Sec. B-185. 12 MRSA §§11853 and 11855, as enacted by PL 2003, c. 414,
Pt. A, §2 and affected by Pt. D, §7, are repealed and the
following enacted in their place:

 
§11853.__Closed season; Haley Pond

 
1.__Prohibition.__A person may not hunt waterfowl on Haley
Pond in the Town of Rangeley and Dallas Plantation in the County
of Franklin.

 
2. Penalties.__The following penalties apply to violations of
this section.

 
A.__A person who violates subsection 1 commits a civil
violation for which a fine of not less than $100 nor more
than $500 may be adjudged.

 
B.__A person who violates subsection 1 after having been
adjudicated as having committed 3 or more civil violations
under this Part within the previous 5-year period commits a
Class E crime.

 
§11855.__Unlawful use of migratory game birds

 
1. Prohibition.__Unless specifically permitted by regulations
of the federal Migratory Bird Treaty Act, 16 United States Code,
Sections 703 to 712, or by rules adopted by the commissioner in
conformity with Title 5, Part 18, except section 8052, subsection
3 of that Title, a person may not:

 
A.__Hunt migratory game birds;

 
B.__Possess migratory game birds;

 
C.__Transport migratory game birds; or

 
D.__Buy or sell migratory game birds.

 
2. Penalty.__A person who violates subsection 1 commits a
Class E crime.

 
Sec. B-186. 12 MRSA §11856 is enacted to read:

 
§11856.__Pheasants

 
The commissioner shall establish by rule a hunting season for
male pheasants that disallows the taking of female pheasants in
certain areas of the State.__Rules adopted pursuant to this
section are routine technical rules as defined in Title 5,
chapter 375,
subchapter 2-A.__A person may not take a female
