| | | Sec. 1. 38 MRSA §349, sub-§10 is enacted to read: |

| | | 10.__Disposition of fines.__A fine collected under this | | section, including a fine resulting from an administrative | | consent agreement under section 347-A, subsection 4, must be paid | | to the commissioner.__A fine received by the commissioner must be | | applied to expenses of enforcement incurred by the department. |

| | | This bill requires all fines for criminal and civil violations | | of laws administered by the Department of Environmental | | Protection, including fines paid as a result of an administrative | | consent agreement, be paid to the Commissioner of Environmental | | Protection to be applied to the expenses of enforcement incurred | | by the department. |
