Sec. G-1. 12 MRSA §7102-B, first ¶, as enacted by PL 1997, c. 24, Pt. I, §2, is amended to read:
An expanded archery deer hunting license authorizes the holder to hunt for deer with a bow and arrow during an expanded archery deer hunting season in areas designated by the commissioner. Notwithstanding section 7102-A, subsection 6, paragraph C, subparagraph (3) or section 7458, a person who lawfully takes a deer with a bow and arrow during the expanded archery deer hunting season is not precluded from further hunting for deer during that year.
Sec. G-2. 12 MRSA §7102-B, sub-§4, as amended by PL 1997, c. 471, §1, is further amended to read:
4. License fee. The fee for a resident expanded archery deer hunting license is $40. The fee for a nonresident expanded archery deer hunting license is $80. A person 10 years of age or older and under 16 years of age may hunt with a bow and arrow during the expanded archery deer hunting season if that person possesses a valid junior hunting license. Each license holder may take 2 deer during the expanded archery deer hunting season.
Sec. G-3. 12 MRSA §7102-B, sub-§5, as enacted by PL 1997, c. 24, Pt. I, §2, is amended to read:
5. Expanded archery deer hunting season. The commissioner may establish by rule an expanded archery deer hunting season. The season must be determined by the commissioner, except that it may only occur in September only between the first Saturday after Labor Day and December 15th.
Sec. G-4. 12 MRSA §7102-B, sub-§8, as enacted by PL 1997, c. 471, §2, is repealed.
Sec. G-5. 12 MRSA §7457, sub-§1, ¶A, as amended by PL 1991, c. 170, is further amended to read:
A. Except as otherwise provided in this section, section 7102-B, or by rule adopted by the commissioner pursuant to this section, there is an open season on deer in each calendar year in all counties of the State from the 5th Monday preceding Thanksgiving to November 30th. In any year when November 30th falls on a Wednesday, Thursday or Friday, the commissioner may, by rule, extend the open season on deer to the first Saturday in December. In any year in which the commissioner extends the season beyond November 30th, the commissioner shall by rule open the season in the northern portion of the State a week before opening the season in the southern portion of the State. The commissioner may by rule establish for this purpose a northern and a southern zone.
Sec. G-6. Carrying Balances - Inland Fisheries and Wildlife program; lapsed balances. Notwithstanding any other provision of law, $364,845 in fiscal year 1999-00 in the Carrying Balances - Inland Fisheries and Wildlife program and $765,224 in fiscal year 2000-01 lapse to the General Fund. An adjustment must be made during fiscal year 1999-00 and fiscal year 2000-01 to reconcile these amounts to the actual revenue in the 2000-2001 biennium.
Sec. G-7. Carrying Balances - Inland Fisheries and Wildlife program. Notwithstanding any other provision of law, $57,047 in fiscal year 1999-00 in the Carrying Balances - Inland Fisheries and Wildlife program and $58,319 in fiscal year 2000-01 lapse to the General Fund. If the annual undedicated revenues collected for the General Fund from the provisions of the Maine Revised Statutes, Title 12, section 7102-B are less than $118,000 for either of fiscal years 1999-00 or 2000-01, then an adjustment equal to the shortfall in revenue must be made during fiscal year 1999-00 and fiscal year 2000-01 to reconcile these amounts to the actual revenue in the 2000-2001 biennium.
Sec. G-8. Appropriation. The following funds are appropriated from the General Fund to carry out the purposes of this Part.
