Sec. HH-1. HIV Medicaid waiver. The Department of Human Services shall administer a program to provide limited Medicaid coverage to persons who test positive for the human immunodeficiency virus, or "HIV," and who meet the income eligibility requirements. The program must operate within the limitation of appropriated resources and must provide Medicaid benefits as specified in the waiver approval. The program must begin by providing coverage for persons of up to 250% of the nonfarm income federal poverty level and may increase the income limit up to 300% of the nonfarm income federal poverty level based on participation rates and program operating costs. The income eligibility limit must be decreased as to new applicants for enrollment in the program if program expenditures indicate that such a decrease is necessary to operate within appropriated resources. The program must include the payment of premiums by enrollees, depending on income level, and must require payment of a $10 copayment per medication per month. The enrollment card issued to enrollees for the program may not identify the health care diagnosis of the enrollee or the waiver program under which the enrollee is enrolled in Medicaid. The department shall adopt rules to implement the HIV Medicaid waiver program. Rules adopted pursuant to this section are routine technical rules as defined in the Maine Revised Statutes, Title 5, chapter 375, subchapter II-A.
Sec. HH-2. Effective date. The HIV Medicaid waiver program authorized in this Part may not begin prior to July 1, 2002.
