B.__Residents whose incomes are above the level in paragraph
A but who spend 3% or more of their gross incomes on
prescription drugs so that their incomes are below 400% of
the nonfarm income official poverty line when the expenses
are deducted from gross income.

 
4.__Pharmaceutical services.__The department shall enter into
agreements with pharmacists for the provision of the following
services to further the purposes of this chapter:

 
A.__Drug use review;

 
B.__Management of drug therapy;

 
C.__Case management of consumers identified as at high risk
of medication-related problems; and

 
D.__Management of consumer compliance.

 
5.__Rebates.__The department shall negotiate with
pharmaceutical manufacturers for the payment of rebates by the
manufacturers.__Manufacturers are ineligible for participation in
the program if they have not reached rebate agreements with the
department.

 
6.__Evaluation.__The department shall undertake an annual
evaluation of the program and the department's participation in
the consortium, which may be contracted out to a nonprofit
organization.__The annual evaluation must include any drug
formulary adopted by the department, drug efficacy, prescription
size, consumer satisfaction and consumer demand for prescription
drugs not covered by the program.__The annual evaluation must be
distributed to the Prescription Drug Advisory Committee as
established in section 263, and to the public by January 1, 2000
and each year thereafter.

 
7.__Rulemaking.__The department shall adopt rules to implement
this chapter.__Rules adopted under this chapter are major
substantive rules as defined by Title 5, chapter 375, subchapter
II-A.

 
§262.__Prescription Drug Dedicated Fund

 
The Prescription Drug Dedicated Fund, referred to in this
chapter as the "fund," is established to fund the program.__
Rebates received from prescription drug manufacturers pursuant to
this chapter must be deposited in the fund.__Participating
pharmacies and hospitals shall deposit in the fund payments for
prescription drugs received from consumers, minus the service fee
that may be retained by the pharmacies and hospitals pursuant to
rule adopted by the department.__The fund may also receive any
payments due from 3rd-party payors in payment for prescription
