(10)__The name of the contractor who services the system;

 
D.__The presence or prior removal of hazardous materials or
elements on the residential real property, including, but
not limited to:

 
(1)__Asbestos;

 
(2)__Lead-based paint;

 
(3)__Radon; and

 
(4)__Underground oil storage tanks; and

 
E.__Any material defects;

 
2.__Notice.__A notice to the purchaser containing the
following language:__"The purchaser and the owner may obtain
professional advice or inspections of the property and provide
for appropriate provisions in a contract between them concerning
any advice, inspections, defects or warranties obtained on the
property"; and

 
3.__Representations of owner.__A notice to the purchaser
containing the following language:__"The representations in this
property disclosure statement are the representations of the
owner and are not the representations of the agent.__This
information is for disclosure only and is not intended to be a
part of any contract between the purchaser and the owner."

 
If at the time the disclosures are required to be made, an
item of information required to be disclosed under this
subchapter is unknown or unavailable to the owner, the owner may
comply with this subchapter by advising the purchaser of the fact
that the information is unknown.

 
The information provided to the purchaser is based upon the
best information available to the owner.__The owner is not
obligated under this subchapter to make any specific
investigation or inquiry in an effort to complete the property
disclosure statement.

 
The purchaser shall acknowledge in writing receipt of the
property disclosure statement.

 
§174.__Time of disclosure; cancellation of contract

 
1.__Time of disclosure.__The owner of residential real
property under this subchapter shall deliver the property
