Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 28-A MRSA §2077-B, as enacted by PL 1997, c. 501, §6, is
repealed.

 
Sec. 2. 28-A MRSA §2077-C is enacted to read:

 
§2077-C.__Interstate shipping of malt liquor and wine

 
1.__Shipment.__Notwithstanding section 2077 and subject to the
provisions of this section, a person outside of this State may
ship malt liquor or wine to a person in this State if:

 
A.__The sender is licensed in its state of domicile as a
malt liquor or wine manufacturer; and

 
B.__The sender applies for and receives an out-of-state
shipper's license pursuant to subsection 2.

 
2.__Out-of-state shipper's license.__Prior to sending any malt
liquor or wine, the sender shall obtain an out-of-state shipper's
license by:

 
A.__Filing an application with the bureau.__The shipper
shall include a true copy of:

 
(1)__The shipper's current malt liquor or wine
manufacturer's license issued by the shipper's state of
domicile; and

 
(2)__The basic permit and special tax stamp issued to
the shipper by the federal Bureau of Alcohol, Tobacco
and Firearms; and

 
B.__Paying a registration fee of $50.

 
3.__Shipment restrictions and requirements.__A person licensed
pursuant to subsection 2 may ship malt liquor or wine directly to
a person in this State if the following provisions are met.

 
A.__No more than 2.4 gallons of malt liquor and 2.4 gallons
of wine may be shipped per month to a household in this
State.

 
B.__The out-of-state shipper may ship only to a recipient
who is at least 21 years of age and shall ensure that the
malt liquor or wine is for personal use and not for resale.__
Age verification may be accomplished by obtaining the number
of a valid driver's license issued by this State.
