PART CCCC

 
Sec. CCCC-1. Rate schedule, assessment of need and resource allocation. With
regard to the services provided under the MaineCare mental
retardation waiver, by June 1, 2005 the Department of Health and
Human Services shall report on the development of a rate schedule
for services under the mental retardation waiver and a
methodology for application of the rate schedule based on
assessment of individual need and criteria for resource
allocation. The report must include: the base cost of each
service and variations in cost related to geography and service
availability, criteria for needs assessment and resource
allocation, and the projected annual costs of the waiver,
expressed as average costs per person and total costs for the
population enrolled May 1, 2005 and anticipated to be enrolled
January 1, 2006 and July 1, 2006. By January 1, 2006 the
Department of Health and Human Services shall adopt rules for the
rate schedule. Rules adopted pursuant to this section are
routine technical rules as defined in the Maine Revised Statutes,
Title 5, chapter 375, subchapter 2-A.

 
PART DDDD

 
Sec. DDDD-1. Debt Service Funds carried forward. Notwithstanding any
other provision of law, $3,672,000 in the Treasurer's General
Fund Debt Service Account must be carried forward for the same
purpose until June 30, 2006.

 
Sec. DDDD-2. Debt Service Savings transferred to Budget Stabilization Fund.
Notwithstanding any other provision of law, during fiscal years
2005-06 and 2006-07 any balance in the Treasurer's General Fund
Debt Service Account pertaining to General Obligation Bonds not
required by the State Treasurer to pay the cost of debt service
must be immediately transferred by the State Controller to the
Budget Stabilization Fund. Each transfer must be made by June
30th of each fiscal year.
