What is Maine's Law on Smoking Prohibition
Laws concerning smoking in public places can be found in 22 MRS §§1541-1550.
22 MRS §1541(6) defines “smoking”: “’Smoking’ includes carrying or having in one's possession a lighted or heated cigarette, cigar or pipe or a lighted or heated tobacco or plant product intended for human consumption through inhalation whether natural or synthetic in any manner or in any form. ‘Smoking’ includes the use of an electronic smoking device.” Subsection 1-A defines “electronic smoking device.”
22 MRS §1580-A addresses smoking in places of employment. Subsection 9 addresses an exception related to “qualifying clubs.”
22 MRS §1578-B addresses smoking in elementary and secondary schools.
22 MRS §1580-E addresses smoking in state parks and historic sites.
29-A MRS §2120 addresses smoking in vehicles when minor is present. Subsection 4 states, “A person who violates subsection 2 commits a traffic infraction for which a fine of $50 must be adjudged.”
There are also Department of Health and Human Services regulations related to smoking in public places and the workplace.
