Cancelling Consumer Contracts
What is Maine's Law on Cancelling Consumer Contracts
Chapter 2 of the Attorney General's Consumer Law Guide discusses consumer contracts in Maine. Consumers have a three-day period in which to cancel door-to-door or telemarketing sales contracts. This cancellation period does not apply to all contracts (read more about this in Chapter 13 of the Attorney General's Consumer Law Guide).
10 MRS §1210-C establishes restrictions on automatic renewals of online subscriptions and health club memberships. It requires sellers to provide both a "clear, conspicuous and easily accessible disclosure of all material terms of the renewal offer and of the methods that the consumer may use to cancel the subscription or membership" and "obtain the express consent of a consumer to automatic subscription or health club membership renewal prior to enrollment through a check box, electronic signature requirement or other affirmative action by the consumer agreeing to the renewal offer." Sellers are required to provide the consumer with clear and conspicuous notice of an extended automatic subscription renewal "no more than 30 days before the renewal date."
